我国精准扶贫战略实施的法治保障研究

【摘要】：精准扶贫是党的十八大以来我国扶贫开发的战略导向,也是提高扶贫效益的必然选择。这一全新的扶贫理念根植于共同富裕和人权保障理论之上。面对农村贫困状况的新变化,精准扶贫面临着法律供给不足、泛行政化以及工作机制不规范等现实困境,解决新时期扶贫的最有效的途径是依法扶贫。我们应在借鉴国外反贫困成功经验的基础上,善用法治思维和法治方式,健全精准扶贫法治化工作机制,完善贫困地区公共法律服务制度,强化司法保障,加快构建以权利义务关系和主体责任为核心的扶贫法律体系,为精准扶贫提供有力的法治保障。
[Abstract]:Precision poverty reduction is the strategic direction of poverty alleviation and development since the 18th National Congress of the Communist Party of China, and it is also the inevitable choice to improve poverty alleviation efficiency.This new concept of poverty alleviation is rooted in the theory of common prosperity and human rights protection.In the face of the new changes in the rural poverty situation, the precision poverty alleviation is faced with such practical difficulties as insufficient legal supply, pan-administration and non-standard working mechanism. The most effective way to solve poverty alleviation in the new period is to help the poor according to law.On the basis of the successful anti-poverty experience of foreign countries, we should make good use of the thinking of the rule of law and the way of ruling by law, perfect the work mechanism of precision poverty alleviation by law, perfect the public legal service system in poor areas, and strengthen the judicial guarantee.Speed up the construction of the rights and obligations of the relationship and the main responsibility as the core of the legal system of poverty alleviation to provide effective protection of the rule of law.
