社会主义新农村法治问题及对策研究

【摘要】：中国是一个农业大国,农村问题历来是中国的根本问题之一。党在新的历史条件下,根据我国的国情和科学发展观提出建设社会主义新农村的任务,农村问题上升到前所未有的高度。社会主义新农村法治,是指在在遵循“依法治国,建设社会主义法治国家”的治国方略原则下,运用农村法律制度和法律手段管理农村的各项事务。社会主义新农村法治建设不仅是新农村建设的重要内容和内在要求,更是新农村建设的有力支撑和保障。从一定意义上说,没有新农村的法治化,社会主义新农村建设将成为空谈。本文从建设社会主义新农村背景入手,提出了新农村法治存在的问题并探讨了问题产生的根源,提出新农村法治建设应该遵守的原则、选择的路径和对策从而更好的建设新农村法治。本文以马克思主义的立场、观点和方法做指导,在学习、借鉴学术界前辈研究成果的基础上,采取唯物主义哲学的方法,对社会主义新农村法治问题进行了详细的分析研究。本文的研究内容主要包括以下五个方面: 第一部分、绪论。回顾了社会主义新农村法治的国内外研究现状。总结了本文的研究背景、研究的理论意义和现实意义。阐明了本文的研究方法,以引出对新农村法治问题的探讨。第二部分、我国社会主义新农村法治概念界定。这一部分主要介绍了社会主义新农村提出的背景,界定社会主义新农村法治的内涵,并说明了社会主义新农村法治建设的意义,为整个论文的研究奠定了前提和基础。第三部分、我国农村法治发展的历程。主要介绍了我国农村法治的发展进程。我国农村经过三个历史阶段逐渐过渡到法治。本章节为分析农村法治问题和解决法治问题提供了历史的参考依据。第四部分、社会主义新农村法治建设面临的主要问题及成因分析。与城市法治相比较,社会主义新农村法治存在很多问题:新农村法治主体不足,主要表现在:农民的法治主体地位缺失、法律知识缺乏、法律意识薄弱、运用法律的能力不强;法治建设需要完善的法制体系,但是我国农村法治立法体系、执法体系、司法体系和法律监督体系不完善;作为农村民主政治载体的基层民主制度在实践中存在缺陷。并在此基础了探讨了产生问题的经济根源、体制根源和文化根源。第五部分、社会主义新农村法治建设的对策分析,这是本文的核心所在。从宏观方面,新农村法治建设要坚持法治统一原则、公平原则、可持续发展原则。这三项原则是解决农村法治问题的原则性依据。立足我国的国情,农村法治建设不能仅仅依靠政府推进或者社会的自然演进,应该要走政府推进和社会演进相结合的道路。从微观的方面:农村法治建设首先要培育法治主体,而农民才是农村法治建设的主体,其次,要夯实农村的经济基础,经济基础是根本。完善农村的法治体制和基层民主制度,制度是保障。最后要培育农村法治文化,文化是潜在的动力。
[Abstract]:The socialist new rural rule of law is not only the important content and the internal demand of the new rural construction , but also the strong support and guarantee of the new rural construction .

Based on the research achievements of the academic community , this paper makes a detailed analysis and study on the rule of law in the new socialist countryside .

The research contents of this paper mainly include the following five aspects :

The first part , introduction , reviews the domestic and foreign research situation of the rule of law in the new socialist countryside , summarizes the research background , theoretical significance and practical significance of this paper .

The second part is defined by the concept of the rule of law in the new socialist countryside . This part mainly introduces the background of the new socialist countryside , defines the connotation of the new socialist countryside rule of law , and explains the significance of the construction of the new socialist countryside rule by law , which lays a prerequisite and foundation for the study of the whole paper .

The third part , the course of the development of the rule of law in China ' s rural areas , mainly introduces the process of the development of the country ' s rule of law in our country . Our country has gradually transitioned from three historical stages to the rule of law . This chapter provides a historical reference for the analysis of the problems of the rule of law in rural areas and the solution of the rule of law .

The fourth part , the main problems and causes of the construction of the socialist new rural rule of law . Compared with the urban rule of law , there are many problems in the socialist new rural rule of law : the lack of legal knowledge , the weak legal consciousness , the weak ability of applying the law , the imperfect legal system , the imperfect legal system and the legal supervision system .

The fifth part , the countermeasure analysis of the construction of the rule of law in the new socialist countryside is the core of this paper . From the macro aspect , the construction of the new rural rule of law should adhere to the principle of unity of the rule of law , the fair principle and the sustainable development principle .
