基于行政民主的国家治理:以非强制性行政为视角

【摘要】：中国长期以来是一个行政主导的国家,对效率的追求往往遮蔽对民主价值的回应,为了体现国家治理的民主化要求,探讨从"非强制性行政"概念出发来构建行政民主就显得非常必要。从基于"非强制行政"所进行的行政改革进程看,为从"控制行政法学"向"平衡行政法学"的转变也提供了诸多可能性。为了进一步完善行政民主:行政自律是行政民主的前提,行政国家自身要尽可能自律,反思平衡和自我限权,改变过去简单粗暴的强制行政作为;处理好政府与公民之间新型关系,主动开放和迎接公民对行政行为的监督;并积极推进非强制性行政行为的制度化,落实好行政民主。
[Abstract]:China has been an executive-led country for a long time. The pursuit of efficiency often obscures the response to democratic values, in order to reflect the democratic requirements of national governance. It is necessary to construct administrative democracy from the concept of non-compulsory administration. The process of administrative reform based on "non-compulsory administration" provides many possibilities for the transformation from "controlling administrative jurisprudence" to "balancing administrative jurisprudence". In order to further improve administrative democracy: administrative self-discipline is the premise of administrative democracy, the administrative country itself should be self-discipline as much as possible, reflect on the balance and self-restriction of power, change the past simple and violent coercive administrative acts; We should handle the new relationship between the government and the citizens, open up and welcome the citizens' supervision of the administrative behavior, and actively promote the institutionalization of the non-compulsory administrative behavior and implement the administrative democracy.
