当代中国司法程序的法治价值

【摘要】：本文首先通过对司法程序的含义、特征及要素等相关概念的深刻分析,详细地阐述了司法程序的概念、特征及其基本要素。司法程序的基本原则是构成整个司法程序法律体系的灵魂。是贯穿整个程序法之活动的指导思想和出发点。对整个司法程序法律体系具有重要的指导意义。司法程序从其产生、发展到现在,随着社会的发展变化,其对社会的各个方面所起到的作用日益重要,成为现代法治社会的枢纽。司法程序对当代中国社会主义法治社会主要有四方面的作用。我国在建设社会主义的道路上,历经反复实践,总结经验教训,最后终于做出了建设社会主义法治国家的重大决策,并将此作为国家的战略目标写入了《中华人民共和国宪法》之中。回顾和总结马克思主义理论在这一问题中的思想轨迹,探索其中的认识历程和规律,总结汲取其中的失误,对于我们将要继续进行和努力实现的法治国家建设,具有重要的指导意义。党的“十五大”明确确立了依法治国,建设社会主义法治国家的基本方略。结合我国法治建设的现实状况,进行鉴别和分析,在相对理想化的理论愿望基础上找出我国现实法治建设中由偏重实体的倾向,走向程序化法治存在的各种问题和发生这些问题的根源。为进一步对症提出解决这些问题的方针策略,提供参照的依据。最后,笔者提出若干建议。
[Abstract]:In this paper, the concept, characteristics and basic elements of judicial procedure are expounded in detail through the profound analysis of the relevant concepts such as the meaning, characteristics and elements of judicial procedure. The basic principle of judicial procedure is the soul of the whole legal system of judicial procedure. It is the guiding ideology and starting point of the whole procedural law. It has important guiding significance to the whole legal system of judicial procedure. With the development of the society, the judicial procedure plays an increasingly important role in all aspects of the society and becomes the hub of the modern society under the rule of law. The judicial procedure has four main functions to the contemporary socialist society of ruling by law in China. On the road of building socialism, after repeated practice and summing up experience and lessons, China finally made a major decision to build a socialist country ruled by law. As a strategic goal of the country, it was written into the Constitution of the people's Republic of China. Reviewing and summing up the ideological track of Marxist theory in this issue, exploring the course and law of cognition, summing up the mistakes in it, the construction of a country ruled by law that we will continue to carry out and strive to achieve, It has important guiding significance. The 15th National Congress of the Party clearly established the basic strategy of governing the country according to law and building a socialist country ruled by law. Combined with the reality of the construction of the rule of law in our country, this paper identifies and analyzes it, and finds out the tendency of the construction of the rule of law in our country by emphasizing the entity in the construction of the rule of law in reality, based on the relatively idealized theoretical desire. The problems existing in the procedural rule of law and the root causes of these problems. In order to put forward the strategy to solve these problems, and provide reference basis. Finally, the author puts forward some suggestions.
