【摘要】:当前我国食品安全问题十分严重,2008年“三鹿奶粉”事件的爆发,2010年海南“毒豇豆”事件,2010年7月,三聚氰胺超标奶粉事件“卷土重来”。食品安全问题涉及从田间到餐桌的各个方面,不仅危及消费者的人身、财产安全,情况严重的还将影响中国经济的发展、对外贸易及其贸易的全球化以致整个社会的稳定。在此危急之下,《食品安全法》应运而生。《食品安全法》的出台对中国食品安全问题的解决起到了功不可没的作用。然而,仅仅是一部法典的出现并不足以解决中国食品安全的所有问题。当然,食品安全法治的完善是一个长期的过程,世界上任何国家的食品安全法治也是在不断摸索中得到不断进步的。本文从以下几个方面对食品安全法治进行分析和论述:首先,从食品安全概念入手,分析了食品安全的内涵和外延,进而说明对食品安全的法治研究是基于一个食品链的全过程研究,涉及生产、经营、消费等诸多环节和门类。其次,在全面把握我国食品安全现状的基础上,剖析了我国食品安全法律体系、食品安全管理体制、食品安全执法与社会监督等方面存在的问题及其产生的原因。分析表明,基于食品安全的特点,法治建设要求食品安全监管应具有完善的法律体系、科学高效的管理体制、严格的权力监督与制约制度等,而食品安全法律体系及监管体制本身,也存在其固有的本质的要求。再次,认真分析了国外食品安全管理方面的成功经验并从中得到借鉴。最后,借鉴国外的先进经验,针对当前食品安全法治存在的问题,提出了改革、完善现有的食品安全法律体系和监管体制、执法体系的意见和建议。主要从法律和制度两个方面入手,通过《食品安全法》这一基本法的实施,统一规定了保证食品安全的相关制度;法律完善的基础上,理顺监管体制,构建一个法治的、高效的食品安全监管体系,以期实现控制食品安全隐患,保证公众饮食安全的目标。
[Abstract]:At present, the food safety problem in our country is very serious. In 2008, the "Sanlu Milk Powder" incident broke out, the 2010 Hainan "poisonous cowpea" event, in July 2010, the melamine over-standard milk powder event "made a comeback". The food safety problem involves every aspect from the field to the dining table. It not only endangers the consumer's personal and property safety, but also affects the development of Chinese economy, the globalization of foreign trade and trade, and the stability of the whole society. In this crisis, the Food Safety Law came into being. The promulgation of the Food Safety Law has played an important role in solving the food safety problems in China. However, just the emergence of a code of law is not enough to solve all of China's food safety problems. Of course, the improvement of food safety rule of law is a long-term process, and the food safety law of any country in the world has been continuously improved in the process of exploration. This paper analyzes and discusses the rule of law of food safety from the following aspects: firstly, starting with the concept of food safety, the connotation and extension of food safety are analyzed. Furthermore, the research on food safety is based on the whole process of food chain, which involves production, management, consumption and so on. Secondly, on the basis of comprehensively grasping the current situation of food safety in China, this paper analyzes the existing problems and causes of food safety law system, food safety management system, food safety law enforcement and social supervision in China. The analysis shows that, based on the characteristics of food safety, the construction of rule of law requires that food safety supervision should have a perfect legal system, a scientific and efficient management system, strict power supervision and restriction system, etc. And the food safety law system and the supervision system itself, also has its inherent essential request. Thirdly, the successful experience of foreign food safety management is analyzed carefully and used for reference. Finally, based on the advanced experience of foreign countries, the author puts forward some suggestions and suggestions on reforming and perfecting the existing food safety legal system, supervision system and law enforcement system in view of the problems existing in the current food safety law management system. Mainly from the two aspects of law and system, through the implementation of the basic Law of the Food Safety Law, the relevant system for ensuring food safety has been unified and stipulated; on the basis of the perfection of the law, the regulatory system should be straightened out, and a rule of law should be constructed. The aim of controlling hidden dangers of food safety and ensuring public food safety is an efficient food safety supervision system.
