西方法治理念对我国社会主义法制观教育的双重影响

【摘要】：西方法治理念的形成是伴随着西方资本主义制度的产生、演变以及巩固而发展起来的。西方法治理念源远流长,体现在很多的理论和学说中,西方法治理念对我国法治理念提供了重要的参考。 西方法治理念和社会主义法治理念建立在不同的社会经济基础之上,具有不同的内涵和外延。通过对比两者的区别,会清醒地认识社会主义法治理念自身的特点。西方法治理念是一个完整的体系,但是它并不是完全适合我国的社会主义法治建设。我们应该在马克思主义的指导下,结合我国的实际国情,全面地分析西方法治理念对社会主义法治观教育的积极影响和消极影响,扬长避短,使社会法治理念具有更强的时代性和生命力。 西方法治理念具有一定的局限性,因此我们不能完全地照搬西方的法治理念。一方面要反思我国目前法治理念教育存在的问题,看到我国法治理念教育的不足,在这个基础上,借鉴西方法治理念中的合理因素;另一方面,要开创具有中国特色的社会主义法制观教育,使社会主义法制观建设能更好地适应我国的经济、政治和文化的发展水平。
[Abstract]:The formation of the western concept of rule of law is accompanied by the emergence, evolution and consolidation of the western capitalist system. The western concept of rule of law has a long history and is embodied in many theories and theories. It provides an important reference for the concept of rule of law in our country. The western concept of rule of law and the idea of socialist rule of law are based on different social and economic foundations and have different connotations and denotations. By comparing the difference between the two, we will soberly understand the characteristics of the socialist concept of rule of law. The idea of western rule of law is a complete system, but it is not completely suitable for the construction of socialist rule of law in our country. Under the guidance of Marxism, we should comprehensively analyze the positive and negative effects of the western concept of rule of law on the education of socialist view of rule of law, combining with the actual conditions of our country, so as to make the best of our strengths and avoid our weaknesses. The concept of social rule of law has a stronger sense of the times and vitality. The western concept of rule of law has some limitations, so we can not completely copy the western concept of rule of law. On the one hand, we should reflect on the existing problems in the education of the concept of rule of law in our country, and see the deficiency of the education of the concept of rule of law in our country. It is necessary to initiate the education of socialist legal concept with Chinese characteristics so that the construction of socialist legal concept can better adapt to the level of economic, political and cultural development of our country.
