我国大学章程中大学生权利保障研究

【摘要】:在“依法治国”、“依法治校”的指导思想中,大学章程建设显得尤为重要,是实现高校法制管理、科学管理、人性化管理、民主管理的保证。国家相继出台了《国家中长期教育改革和发展规划纲要(2010-2020年)》、《高等学校章程制定暂行办法》等一系列要求加快大学章程建设的规范性文件,尤其是在2013年由教育部颁布的《中央部委所属高等学校章程建设行动计划(2013-2015年)》中提出了大学章程建设的计划目标,要求教育部及中央部门所属的114所高等学校,2015年底分批全部完成章程制定和核准工作。截止到2015年6月底,我国已核准通过了84所高校的大学章程,我国高校在“依法治校”、“依章治校”的道路上迈进了可喜的步伐。为了更有利于高校的持续发展和高等教育改革,对大学章程的研究成为学者们争相探讨的问题,其中较为突出的就是大学生权利保障问题。大学生作为高等教育的重要主体之一,他们亦是受教育者,还是普通公民,他们在校的权利如何保障?高校亦是提供高等教育的载体,还是管理者,他们又将如何处理与大学生权利之间的关系?基于如此,大学章程作为高校总纲领性文件,不仅涉及高校管理及治理体制,也有大学生权利及其保障的内容,促使笔者以大学章程为立足点,探索大学生权利保障的问题。本研究在大学章程的框架下,结合时下我国已经审核批准的84所高校的大学章程的文本,运用了文献资料法、对比分析法和系统分析法,通过对大学章程章节结构和大学生权利在大学章程中呈现的文本现状进行分析,找到大学章程在大学生权利保障中存在的问题与不足,又结合现实情况分析出存在问题的原因,探索出以大学章程推进高校大学生权利保障实现的途径。希望本研究对大学章程在高校大学生权利保障的制定与实施,推动我国大学章程建设的健全与完善提供一定的参考价值。本文共分为五章:第一章为绪论,阐述了本研究的背景、目的、意义及研究方法;第二章为大学生权利相关理论分析,该章分为三个小节:大学生权利内涵、大学生权利的依据和大学生权利基本内容,主要从权利出发,首先论述了权利的表现形式及三个阶段,和大学生拥有特殊的“双身份”——公民和学生,其次介绍了大学生权利的依据来源于法律规定和政策规定,其三从大学生权利与教育学习的关联性详细描述了大学生权利基本内容——三大类权利、十五小类权利。第三章为大学章程在高校大学生权利保障中的价值,首先从大学章程的定义、特征、属性对大学章程的内涵进行了阐述,说明了大学章程在高校管理中的重要地位,其次阐述了大学章程在大学生权利中的价值:即大学章程是实现大学生权利的基础,是监督的学生权利的依据,是落实大学生权利的保证。第四章为我国大学章程中高校大学生权利保障的现状分析,这也是本研究的核心章,在本章中以目前已审核批准通过的84所高校的大学章程为样本,运用文本分析法、对比分析法、系统分析法对大学章程的章节结构和大学章程中大学生权利进行了文本分析,从两条路径进行分析:第一条路径是对各高校大学章程的章节结构和各章节条款说占比例情况进行分析发现大学章程依然重视管理体制,对大学生重视程度不够,第二条路径主要针对大学章程中的大学生权利进行分析,找出一下几点问题:第一,大学生权利主体地位不明确,第二,大学生权利的内容不完整,第三,大学生权利保障机制不健全,第四,大学生权利救济渠道不畅通,进而寻求产生问题的三点原因:一、大学章程受其上位法的影响;二、大学生自身权利责任意识薄弱;三、高校管理与大学生权利的关系冲突。第五章为以大学章程推进我国高校大学生权利保障的实现,分别从四个维度——以大学章程推进大学生权利的地位,以大学章程推进大学生权利的规范,以大学章程推进的学生权利的运作,以大学章程推进大学生权利的监督,来论述要通过明确大学章程的法理地位、提高大学生在大学章程中的主体地位、完善大学生权利的基本内容、畅通大学生权利救济渠道、遵守大学章程对大学生权利的规定、建立大学生权利的配套制度、加大大学生权利学习宣传力度以及社会、国家、学校、大学生多方共同努力、共同监督从而推进高校大学生权利保障的实现。本研究的创新之处就是运用新的研究视角即在大学章程中来探讨高校大学生权利保障问题,这不仅能丰富大学章程的内容,完善和充实大学章程的建设,还能为解决高校大学生权利保障的现实问题提供参考。本研究的特色是实践性与理论性相结合,需要查询大量的资料,包括大学章程和高校大学生权利保障的文献资料以及我国已审核批准的高校大学章程在高校大学生权利保障的数据统计及内容分析整理。
[Abstract]:In the guiding ideology of "governing the country by law" and "governing the school according to law", the construction of the University constitution is particularly important. It is the guarantee for the realization of the legal management, scientific management, humanized management and democratic management of colleges and universities. The state has successively promulgated the national medium and long term education reform and development plan (2010-2020 years), and the provisional measures for the formulation of the institutions of higher learning. A series of standardized documents for speeding up the construction of University articles of association, especially in 2013 by the Ministry of Education issued by the Ministry of education, the plan of the statute construction action plan of the higher schools affiliated to the central ministries (2013-2015 years), put forward the planned objectives of the construction of the University constitution, which require the Ministry of education and the 114 institutions of the central department to be owned by the end of 2015. By the end of June 2015, our country has approved the constitution of 84 colleges and universities. Our universities have made a happy step on the road of "running school according to law" and "governing the school according to the rules". In order to be more conducive to the continuous development of universities and the reform of higher education, the study of the University constitution has become a scholar. One of the more prominent issues is the guarantee of the rights of college students. As one of the important subjects of higher education, they are also the educated and ordinary citizens. How to guarantee their rights in school? Colleges and universities are also the carrier of higher education, or the managers, how they will deal with the rights of college students. On the basis of this, the University constitution, as a leading document of the university general programme, not only involves the management and management system of colleges and universities, but also has the content of the rights and security of college students. The author, taking the University constitution as the foothold, explores the problem of the guarantee of the rights of college students. The text of the University articles of association of the 84 approved universities, using the document method, the comparative analysis method and the system analysis method, analyzes the present situation of the text of the University constitution and the college students' rights in the University constitution, and finds the problems and shortcomings of the University constitution in the guarantee of the rights of the university students, and also combines the reality. The reasons for the problems are analyzed, and the ways to promote the guarantee of College Students' rights are explored. This study hopes to provide some reference value for the Constitution and implementation of university students' rights guarantee and the improvement and perfection of the construction of University constitution in China. This paper is divided into five chapters: the first chapter The introduction describes the background, purpose, significance and research methods of this study. The second chapter is about the theoretical analysis of the rights of college students. This chapter is divided into three sections: the connotation of the rights of college students, the basis of the rights of college students and the basic content of the rights of college students. Secondly, it introduces the basis of the rights of college students from the legal provisions and policy provisions. The third chapter is the University constitution in Colleges and universities. The value of College Students' rights protection, first of all, from the definition, characteristics and attributes of the University constitution, expounds the connotation of the University constitution, illustrates the important position of the University constitution in the university management, and then expounds the value of the University constitution in the college students' Rights: that is, the University chapter is the basis for realizing the rights of the university students and the study of the supervision. The basis of the right to birth is the guarantee for the implementation of the rights of college students. The fourth chapter is an analysis of the current status of the protection of College Students' rights in University articles of association in our country. This is the core chapter of this study. In this chapter, the constitution of the 84 colleges and universities which have been approved and approved at present is the sample, using text analysis, comparative analysis and systematic analysis. The chapter structure of the University articles of association and the text analysis of College Students' rights in the University articles of association are analyzed from the two paths. The first path is to analyze the chapter structure and the proportion of the articles of the universities and colleges. It is found that the university regulations still attach importance to the management system and not pay enough attention to the university students, second The article mainly analyzes the rights of college students in the University's articles of association and finds out some problems: first, the status of the rights subject of college students is not clear, second, the content of the rights of college students is incomplete, third, the rights protection mechanism of college students is not sound, Fourth, the channel of right relief for college students is not smooth, and then seeks three of the problems. The reasons are as follows: first, the University constitution is affected by its upper law; two, college students' own rights and responsibilities are weak; three, the conflict between university management and the rights of college students. The fifth chapter is to promote the realization of the protection of the rights of college students in the University of our country with the University constitution, from four dimensions to promote the status of College Students' rights with the University constitution. In order to promote the rights of college students by the constitution of the University, the rights of the students promoted by the University articles of association and the supervision of the rights of college students are promoted by the constitution of the University. It is discussed that the legal status of the University articles of association should be clearly defined, the main position of the college students in the University constitution is raised, the basic content of the rights of the university students is finished, and the rights of the university students are unblocked. The remedy channels, abide by the regulations of the University's articles of association on the rights of college students, set up a supporting system for the rights of college students, increase the publicity of the rights of college students, and work together in the society, the state, the school and the college students to promote the realization of the guarantee of the rights of college students. The innovation of this study is to use the new research. The angle of view is to discuss the problem of the guarantee of College Students' rights in the University constitution, which not only enriches the contents of the University's articles of association, improves and enriches the construction of the University constitution, but also provides a reference for solving the practical problems of the rights guarantee of college students. It includes the documents of the University constitution and the protection of College Students' rights, and the data statistics and content analysis of the University University's charter in our country which has been approved and approved in the University.
