治理政府采购领域商业贿赂的法制对策研究

【摘要】： 政府采购在国民经济体系中扮演着十分重要的角色,但随着社会竞争不断的加剧,政府采购过程中的不足和漏洞也随之显现,政府采购领域成为商业贿赂发生的重灾区,影响十分恶劣。加强对治理政府采购领域商业贿赂的法律和制度对策研究,对于保证我国政府采购良性健康发展,促进社会主义市场经济体制的完善具有重大而深远的理论和现实意义。本文从阐述政府采购和商业贿赂相关概念开始,然后指出政府采购领域商业贿赂的现状及其破坏正常的市场竞争环境、降低政府管理职能、损害了采购人和消费者利益、滋生腐败和行业不正之风等危害,进而深入分析了原因,即政府采购发展的不健康、政府采购相关法律体系的不健全、政府采购程序的不规范、政府采购的监管制约机制的不完善、市场经济体制的不完善。最后在分析国外治理政府采购领域商业贿赂的经验以及总结其对我国的启示之后,着重就健全政府采购和反商业贿赂法律体系、健全政府采购各类相关管理制度、健全政府采购监督机制、建立政府采购领域反商业贿赂长效机制等四个方面提出了对策建议,以期对我国政府采购领域反商业贿赂有所帮助。
[Abstract]:Government procurement plays a very important role in the national economic system, but with the increasing competition in society, the deficiencies and loopholes in the process of government procurement also appear, and the field of government procurement has become a serious disaster area of commercial bribery. The effect is very bad. It is of great theoretical and practical significance to strengthen the study on the legal and institutional countermeasures to govern commercial bribery in the field of government procurement to ensure the healthy development of government procurement in China and to promote the perfection of socialist market economy system. This paper begins with the related concepts of government procurement and commercial bribery, and then points out the present situation of commercial bribery in the field of government procurement and its damage to the normal market competition environment, to reduce the government management function, and to harm the interests of buyers and consumers. The reasons are that the development of government procurement is unhealthy, the relevant legal system of government procurement is not perfect, and the procedure of government procurement is not standardized. The supervision and restriction mechanism of government procurement is not perfect, and the market economy system is not perfect. Finally, after analyzing the experience of foreign countries in governing commercial bribery in the field of government procurement and summarizing its enlightenment to our country, the author puts emphasis on perfecting the legal system of government procurement and anti-commercial bribery, and perfecting all kinds of relevant management systems of government procurement. Four countermeasures are put forward to improve the supervision mechanism of government procurement and to establish a long-term mechanism of anti-commercial bribery in the field of government procurement in order to help our country in the field of anti-commercial bribery.
