论构建社会主义和谐社会的法治路径

【摘要】： 构建社会主义和谐社会既是我们的理想,又是一个实践性极强的法治建设过程。本文以马克思主义理论为指导,以社会主义和谐社会为视角,以社会不同领域的法治建设为研究重点,对社会主义和谐社会、法治、以及二者的关系进行了一定的梳理,分析了产生社会不和谐的法治原因,并较为深入系统地探索了实现社会主义和谐社会的法治路径。首先,针对社会主义和谐社会的理论渊源,本文提出并分析了我国社会主义和谐社会的概念(社会主义和谐社会应该是建立在法治基础上的,以人民群众为主体的,能充分体现我国社会主义本质的一种动态发展的系统状态);以和谐社会的历史发展与实现程度为标准,将和谐社会分为传统的和谐社会、当代的和谐社会和未来的和谐社会即共产主义社会,并对其做了分析比较,指出共产主义社会是社会主义和谐社会的最终目标。其次,从法治的形式价值和实体价值方面分析梳理了社会主义法治。接着,阐述了社会主义法治与社会主义和谐社会的的内在联系,指出法律是追求社会和谐的产物,法治是和谐社会的内在要求,二者相辅相成,辩证统一,健全的法治是社会主义和谐社会的主要标志之一。接着通过实证的方法分析指出当前社会生活在经济、政治和思想文化,司法等方面的最大不和谐,即收入差距的扩大、公权对私权的侵犯和腐败问题以及拜金主义与腐朽没落的文化生活、司法执行难以及司法领域的其他不和谐因素等,比较深入地分析了产生这些问题的原因:不成熟的市场经济与不健全的法治并存;政治生活中的“权”与“法”的关系没有彻底理顺;全社会的法治文化没有彻底形成,法律信仰比较弱;司法体制尚未理顺等问题。最后,着力论述了构建社会主义和谐社会的法治路径,在经济方面要加强市场法治,完善社会主义市场经济体制;在政治方面要加强执政党、政府和公民参与的法治建设;在文化方面要加强法治文化建设,推进法制宣传教育,从而增强法律信仰;在司法领域中,理顺司法部门与党和人大的关系,理顺司法改革与现行法律构架的关系,理顺尊重司法规律与确立司法为民宗旨的关系。
[Abstract]:Building a harmonious socialist society is not only our ideal, but also a practical process of legal construction. Under the guidance of Marxist theory, from the perspective of socialist harmonious society, and focusing on the construction of the rule of law in different fields of society, this paper combs the socialist harmonious society, the rule of law, and the relationship between them. This paper analyzes on the causes of the rule of law which produce social disharmony, and probes into the rule of law path to realize the socialist harmonious society in depth and systematically. First of all, aiming at the theoretical origin of the socialist harmonious society, this paper puts forward and analyzes the concept of the socialist harmonious society in China (the socialist harmonious society should be based on the rule of law and take the people as the main body. It can fully reflect the essence of socialism in our country a dynamic development of the system state, with the historical development of a harmonious society and the degree of realization as the standard, the harmonious society is divided into the traditional harmonious society, This paper analyzes and compares the contemporary harmonious society and the future harmonious society, that is, the communist society, and points out that the communist society is the ultimate goal of the socialist harmonious society. Secondly, it analyzes the socialist rule of law from the aspects of formal value and substantive value. Then, it expounds the internal relation between the socialist rule of law and the socialist harmonious society, and points out that the law is the product of the pursuit of social harmony, and the rule of law is the internal requirement of the harmonious society. A sound rule of law is one of the main symbols of a harmonious socialist society. Then it points out that the biggest disharmony of social life in economy, politics, ideology and culture, judicature, and so on, is the widening of income gap. The violation and corruption of private rights by public power, the cultural life of money worship and decay, the difficulty of judicial execution and other disharmonious factors in judicial field, etc. The reasons for these problems are analyzed in depth: immature market economy and imperfect rule of law; the relationship between "right" and "law" in political life is not completely straightened out; and the culture of rule of law in the whole society has not been formed completely. The legal belief is relatively weak; the judicial system has not been straightened out and so on. Finally, the paper discusses the rule of law path of constructing socialist harmonious society, strengthens the market rule of law in the economic aspect, consummates the socialist market economy system, strengthens the ruling party, the government and the citizen participation in the political aspect the rule of law construction; In terms of culture, we should strengthen the construction of the culture of rule of law, promote the propaganda and education of the legal system, and thus strengthen the belief in law; in the judicial field, we should straighten out the relationship between the judiciary and the Party and the people's Congress, and straighten out the relationship between the judicial reform and the current legal framework. Straighten out the relationship between respecting the law of justice and establishing the aim of judicature for the people.
