区域经济一体化中府际间利益的法制协调

【摘要】：在区域经济一体化进程中,各地方政府从竞争转向合作,共同治理跨区域公共行政事务是共赢发展之道。府际合作能否成功,取决于各地方政府能否就彼此之间的利益冲突进行有效协调。促成府际间利益协调从政策调整向法律调整转型,是建设法治政府的时势所需。作为一项制度安排,府际间利益协调当以法制协调为导向,关涉府际间利益协调的立法,可以采取"综合立法—单行立法"相结合、"中央立法—地方立法"相结合的立法体例,并遵循公平与效率相结合原则、互信共赢原则和公开参与原则,通过构建利益表达机制、利益磋商机制、利益协议机制、利益补偿机制、利益协调监督机制与利益纠纷裁决机制,从而将府际间利益协调纳入法律规制范围。
[Abstract]:In the process of regional economic integration, the local governments turn from competition to cooperation, and the common governance of interregional public administration affairs is the way of win-win development. The success of inter governmental cooperation depends on the effective coordination between the local governments on the conflict of interests between each other. As a system arrangement, as a system arrangement, the inter governmental interest coordination should be guided by the legal coordination and the legislation of intergovernmental interest coordination, which can be combined by "comprehensive legislation, single line legislation", "central legislation and local legislation", and follows the principle of combining fairness with efficiency. The principle of mutual benefit and public participation, through the construction of interest expression mechanism, interest consultation mechanism, interest agreement mechanism, interest compensation mechanism, interest coordination supervision mechanism and interest dispute decision mechanism, so that the inter governmental interest coordination is included in the scope of legal regulation.
