【摘要】：近年来,随着我国依法治国方略的不断落实以及法治化进程的不断加快,公民权利与法制意识明显增强,越来越多的公民懂得通过法律手段来维护自身的合法权益,大学生思想政治教育管理也同样面临着一场适应国家法治化进程的深刻变革。依法治校,就是高校管理者以实现学校管理与运行机制的制度化、规范化为目标,依照法律对学校各项事务进行管理,逐步实现政府宏观管理,学校依法’按照章程自主办学,依法接受监督的格局。依法治校本质上就是正确处理高校师生之间法律关系的动态过程,因此可以说,学生管理工作尤其是思想政治教育管理和程序流程的法治化是依法治校的重要支点。将大学生思想政治教育管理工作纳入法治化的轨道也成为了时代发展的必然。大学生思想政治教育管理工作的好坏是影响高校办学质量、制约高等教育发展最为重要的因素之一。大学生思想政治教育管理法治化建设是社会主义市场经济的客观要求,是培养社会主义合格建设者和可靠接班人重要保障,是用法律的手段保障社会主义办学方向的需要,也是大学生思想政治教育管理自身创新发展的需要。近年来伴随着依法治校的进程,高校涉诉案件的数量和复杂程度日益提高,既有的大学生思想政治教育管理暴露出立法水平不高,现行法律规定过于原则,缺乏可操作性的因素；也有大学生思想政治教育管理行为不注重程序规范,未能做到资源的优化配置,在处理违纪学生时,未能做到全过程法治化等方面的原因。大学生思想政治教育管理理念、程序、权威以及大学生思想政治教育管理者的法律水平等都面临着前所未有的挑战,高校必须采取相关对策,学会用“法治”的理念来解决实践中出现的情况和问题,“法治化”便成为了大学生思想政治教育管理工作的必由之路。大学生思想政治教育管理法治化是一项系统工程。通过加强高校思想政治法制建设,注重对高校校内规定的审查,确保下位法不违背上位法的原则和精神,确保“良法之治”；以完善学生权利救济制度为契机,在大学生思想整治教育和管理中更加注重程序规范,适当借鉴听证、仲裁等制度。通过积极营造依法治校良好环境,切实树立大学生思想整治教育和管理法治、平等和服务的理念,进一步完善大学生思想整治教育管理的运作模式,扎实推进大学生思想政治教育管理法治化建设。当然在实施大学生思想整治教育和管理法治化的过程中,也要注意避免用法治来代替大学生思想整治教育的误区,大学生思想政治教育管理法治化进程中思想政治教育立法和执法都要坚持适度性原则,注意避免思想政治教育过程中的全面法律化。依法治校是现代学校管理的理性追求,大学生思想政治教育管理法治化是建立现代大学制度重要内容,是高等教育科学发展的重要保障。

Running a school according to law means that the university administrator aims at institutionalizing and standardizing the management and operation mechanism of the school, manages the affairs of the school according to the law, gradually realizes the macroscopic management of the government, and the school runs a school independently in accordance with the regulations. The legalization of ideological and political education management of college students is a systematic project. Through strengthening the construction of ideological and political legal system in colleges and universities, paying attention to the examination of the regulations in colleges and universities, ensuring that the inferior law does not violate the principle and spirit of the superior law, ensuring "good law governance", taking the perfect relief system of students' rights as an opportunity, In the education and management of college students' ideological improvement, we should pay more attention to the procedure standard, draw lessons from the system of hearing, arbitration and so on.
