社会主义法治理念与资本主义法治理念比较研究

【摘要】：法治理念是指法治的理想和信念,是人们对法治的价值追求和实现途径抱有的崇高理想和坚定信念。她回答的是什么是法治、为什么要实现法治和怎样实现法治的问题。社会主义法治理念是在社会主义制度条件下形成的,对维护、促进社会主义法治具有重大作用的关于法治的理想和信念。其包含的基本内容为：依法治国、执法为民、公平正义、服务大局和党的领导。资本主义法治理念是在资本主义制度条件下形成的,对维护、促进资本主义法治具有重大作用的关于法治的理想和信念。其包含的基本内容为：依法治国、保障人权、公平正义、分权制衡和司法独立。社会主义法治理念与资本主义法治理念是法治发展进程中形成的两种类型的法治理念,她们之间既有联系又有区别,社会主义法治理念是对资本主义法治理念的批判继承和发展超越。在价值追求上,社会主义法治理念与资本主义法治理念具有形式上的共同点,但在具体内容上则有质的区别；在实现途径上,两者却是完全不一样的,社会主义法治理念强调的是服务大局和党的领导,而资本主义法治理念则提倡司法独立和分权制衡。以社会主义法治理念对照我国今天的法治建设,我们还存在着诸多不足之处,我们应该在社会主义法治理念的指引下不断完善社会主义法治建设。
[Abstract]:The concept of the rule of law refers to the ideal and belief of the rule of law, the lofty ideal and firm belief that people hold in the pursuit of the value of the rule of law and the way to realize it. The ideals and beliefs about the rule of law, which play an important role in the socialist rule of law, include the following basic contents: ruling the country by law, enforcing the law for the people, being fair and just, serving the overall situation and the leadership of the Party. The ideals and beliefs of governing the country include: governing the country according to law, guaranteeing human rights, fairness and justice, checking and balancing power and judicial independence. In the value pursuit, the socialist concept of rule of law and the capitalist concept of rule of law have formal similarities, but there are qualitative differences in the specific content; in the way of realization, the two are completely different, the socialist concept of rule of law emphasizes the overall situation and the party. Compared with our country's legal construction today, we still have many shortcomings. We should constantly improve the socialist legal construction under the guidance of the socialist legal concept.
