论中国法制现代化成长机理

【摘要】： 法制现代化是现代化发展的子系统,是社会发展在法制建设领域表现出的历史必然,是极具复杂性、艰难性、渐进性的社会发展运动。现代化是世界发展的大趋势,成为各个国家共同追求的目标。尽管不同社会的法制发展进程不尽相同,表现出鲜明的历史阶段性差异。但是,这并不代表世界法制现代化的发展是零散的,毫无规律可循的,相反,它有自身的成长机理。法制现代化是现代化发展的历史必然,法制现代化发展的过程是现代化发展的有机组成部分。据此,进一步展开对法制现代化内涵与特征的讨论,从其发展的不同模式中说明各个国家在这一历史进程中表现出的共同特征,并在此基础上总结出世界法制现代化所具有的、普遍意义的成长机理。 十一届三中全会以来,通过对正反两个方面历史经验教训的总结,中国走上了中国特色的法制现代化建设道路。回顾这一段历史,这一“道路”的最终确立具有历史必然性。但是,它不代表中国法制现代化理论发展到了光辉的顶点,该理论有其形成的历史脉络。从对世界法制现代化成长机理的认知中,把握中国从近代以来法制建设与发展的历史脉动,是一个颇具理论性与现实性的问题。因为,对中国法制现代化发展进程特征的认识,既有助于我们建设社会主义法制现代化,规划社会主义法制建设蓝图;也有助于我们正确认识全球化法律发展对中国法制现代化的影响。基于此,以世界法制现代化成长机理为参照系,历史发展时期为主轴,将近代以来中国法制现代化建设分为四个历史时期,论述中国法制建设发展的历史阶段性特征并对其加以整合,用来说明:第一,法制现代化成长机理具有历史内在规定性,对它的遵循与背离直接决定了社会法制变革运动的成败;第二,必须建立中国特色的法制现代化理论,过分依赖世界法制现代化的一般模式,并不利于中国法治国理想的实现,而对传统资源的创造性转化,则可能成为一种符合实际的选择。 总体上看,在对中国法制现代化成长历史过程的梳理中,论证了它是一个与法制现代化一般发展规律的互动过程,体现出一定的实践逻辑特征。针对于此,借助对传统价值理念——和谐的解读,并联系我国法制现代化发展的客观情况,论证在当代中国,和谐是我国法制现代化法制进一步变革的基础——传统与国情。文章最后,我讨论了中国法制现代化进一步发展的传统资源问题。
[Abstract]:Modernization of the legal system is a subsystem of modernization and a historical necessity of social development in the field of legal system construction. It is a movement of social development characterized by complexity, difficulty and gradual progress. However, this does not mean that the development of legal modernization in the world is fragmentary and irregular. On the contrary, it has its own growth mechanism. Legal modernization is the historical necessity of the development of modernization, and the process of legal modernization is an organic part of the development of modernization. This paper discusses the connotation and characteristics of the modernization of the legal system, explains the common characteristics of each country in this historical process from the different modes of its development, and on this basis summarizes the universal growth mechanism of the modernization of the world's legal system.
Since the Third Plenary Session of the Eleventh Central Committee, China has embarked on the road of legal modernization with Chinese characteristics by summing up the historical experience and lessons from both positive and negative aspects. Looking back on this period of history, the final establishment of this "road" has historical inevitability. It is a theoretical and realistic problem to grasp the historical pulsation of China's legal system construction and development since modern times from the understanding of the growth mechanism of the world's legal system modernization. It is also helpful for us to correctly understand the influence of the development of global law on the modernization of China's legal system. Based on this, this paper divides the modernization of China's legal system into four historical periods, taking the growth mechanism of the modernization of the world's legal system as the reference frame and the historical development period as the main axis, and expounds the Chinese law. The historical and periodic characteristics of the development of the system construction and their integration are used to illustrate: firstly, the growth mechanism of the modernization of the legal system has its historical inherent stipulation, and its follow and deviation directly determine the success or failure of the movement of social legal system reform; secondly, we must establish the theory of legal system modernization with Chinese characteristics and rely too much on the modernization of the world legal system The general model is not conducive to the realization of the ideal of China's rule of law, but the creative transformation of traditional resources may become a practical choice.
Generally speaking, in combing the historical process of the development of China's legal system modernization, it is proved that it is an interactive process with the general law of development of legal system modernization, reflecting certain practical logic characteristics. In contemporary China, harmony is the foundation of the further reform of China's legal system modernization - tradition and national conditions. Finally, I discuss the issue of traditional resources for the further development of China's legal system modernization.
