集体谈判与民主参与——历史关系与制度安排的视角

【摘要】：作为产业民主的两种重要形式,集体谈判和民主参与虽然在目标、运行方式等诸多方面存在着差别,但是,西方国家的历史实践表明,两者同时也存在紧密的联系。民主参与既与集体谈判形成竞争,同时也严重依赖集体谈判。在制度安排上,民主参与更像是集体谈判的一种补充机制。与之相较,我国的集体协商与民主参与趋同化特征明显,尤其是集体协商的"去对抗性"不仅使自身难以摆脱形式化的泥潭,也使得民主参与的真正落实缺乏有效的保障。注重依赖职工而非过度依赖政府或许是国外相关实践给我们的一个重要启示。
[Abstract]:As two important forms of industrial democracy, collective bargaining and democratic participation are different in many aspects, such as goal and mode of operation, but the historical practice of western countries shows that there is also a close relationship between the two at the same time. Democratic participation not only forms competition with collective bargaining, but also relies heavily on collective bargaining. In institutional arrangements, democratic participation is more like a complementary mechanism to collective bargaining. In contrast, the convergence characteristics of collective consultation and democratic participation are obvious in our country. Especially, the "de-antagonism" of collective consultation not only makes it difficult to get rid of the formalized quagmire, but also makes the real implementation of democratic participation lack of effective guarantee. Focusing on workers rather than over-dependence on the government may be an important revelation to us by relevant practices abroad.
