“一带一路”纠纷仲裁解决机制研究——以东部陆海丝绸之路经济带为例

【摘要】：商事仲裁已在全球范围内成为解决跨国经济纠纷的国际通用方式,仲裁也已成为国内侧重解决经济领域重大纠纷的重要选择。在"一带一路"国家发展战略中,建立以仲裁为核心的纠纷解决机制现实可行。在建立仲裁解决纠纷机制中,基于区域特征差异化明显的特点,分地区构建以满足区域发展需要的,更富有历史承接性与现实可行性的仲裁解决机制至关重要。以"一带一路"重要组成部份的"东部陆海丝绸之路经济带"为例,通过建立东北部区域性国际仲裁机构,制定对东北部沿线国家与地区包容性更强的仲裁规则,建立具有国内外多元文化的仲裁队伍,以及探索更具有效性的仲裁机制,切实为积极参与"一带一路"东部发展的各个国家及各省区经济活动提供更有力的法治保障。
[Abstract]:Commercial arbitration has become an international and universal way to solve transnational economic disputes in the world, and arbitration has become an important choice to solve the major disputes in the economic field. In Belt and Road's national development strategy, it is feasible to establish a dispute settlement mechanism with arbitration as the core. In order to meet the needs of regional development, it is of great importance to establish a more historical and feasible arbitration settlement mechanism based on the distinct characteristics of regional characteristics in order to meet the needs of regional development in the establishment of arbitration dispute resolution mechanism. Taking the "Eastern Land and Sea Silk Road Economic Belt", an important part of "Belt and Road", as an example, through the establishment of regional international arbitration institutions in the Northeast, we will formulate more inclusive arbitration rules for countries and regions along the northeast. To establish a multi-cultural arbitration team at home and abroad, and to explore a more effective arbitration mechanism, to provide a more effective legal guarantee for the economic activities of each country and the provinces and regions actively participating in the development of "Belt and Road" in the east.
