关联理论视角下《中华人民共和国宪法》英译研究

　　随着经济全球化进程的日益发展,中国与其他国家的交流更加频繁与深入。经济与贸易的国际化使得国家间对法律翻译的需求日趋迫切。目前中国的法律翻译水平尚未令人满意,有待进一步提高。多数国家的法律体系是几个世纪以来文化和道德发展的产物。在此背景下,法律译者不仅必须协调语言和文化之间的差异,并且还要在不同法律传统之间架起桥梁。宪法作为国家的根本法,为其它法律奠定基础,因而它的翻译准确度不仅直接影响影响其法律效力,而且也为其它法律的翻译提供借鉴。关联理论应用于翻译领域已久,也有学者将该理论应用于法律翻译领域,力图将部分不同法律体系的法律概念实现最大程度贴近原文的翻译。关联理论最初是语义学中的一个理论,其中最为重要的概念,如最佳关联、语境效果与处理努力等已应用于翻译领域,被理解为英译本读者与英译文之间的一种文本“交流”。本文立足关联理论及关联翻译理论,试图在理论框架内,从词汇、句子结构以及文化差异等方面对《中华人民共和国宪法》的英译本进行比较全面地分析,发现现有宪法英译本的可取与不足之处,以此为其它法律翻译提供有利的借鉴,避免因翻译而产生的歧义与误解,促进中国法律在其它国家的影响力。
