功能翻译理论指导下商务合同汉译的实践报告

　　自改革开放以来,中国与世界各国的经济合作和贸易往来明显增多,尤其是中国提出“一带一路”的发展倡议之后,中国与沿线各国的贸易活动又步入了一个全新的发展时期。商务合同是当事人从事商务活动或与商务相关的活动中为实现一定的经济目的而明确相互的权利与义务关系的文书,其严格的准确性、规范性和法律约束力在各种贸易活动中扮演着不可或缺的角色。本篇实践报告的翻译材料为《乌克兰尼科波尔市光伏发电站的供应合同》。翻译材料来自于笔者在青建国际公司实习期间的一项翻译任务,本合同规定了合同双方的权利与义务,本合同除主体条款外还有三个附件,分别为技术规范、运输证书表、竣工证书表。本翻译文本的目标读者为青建国际相关项目负责人,目的在于使项目负责人明确合同条款以及权利与义务。过去传统翻译理论要求译文“对等”,然而,20世纪70年代,德国功能学派提出了功能翻译理论,其代表人物分别是卡特琳娜·莱斯、汉斯·弗米尔、克里斯蒂安·诺德。该理论最核心的两个概念则是翻译目的论与翻译行为理论,弗米尔曾提出“翻译目的决定翻译方法”并且功能翻译理论认为译者地位高于原文作者.就商务合同而言,其本身具有法律效力,其使用语言为商务合同英语,又具...
