基于语料库的汉语立法语篇情态操作语英译研究

　　法律语言是法律的载体,与普通语言不同,更具有权威性和法律约束力。作为其核心部分,立法语言在法律、法规和条约等书面法律文件中,通过语言反映国家权力和意志。随着国际交往日益频繁,中国法律法规翻译中存在的问题给对外交流和贸易造成巨大困难。依据系统功能语法,翻译不仅是语际之间的转换,更重要的是,它更是在特定社会语境中的交际过程。法律语言的翻译包含大量的含有情态操作语的陈述句,用以突显法律主体的权利、义务和禁止功能。同时,法律语言在国家权力和人民履行义务方面也扮演着重要角色。由于可表示不同等级的义务和意愿,所以情态操作语能体现国家意志。在立法语篇中,法律规范可根据其确立的行为模式分为三个范畴:授权性法律规范、义务性法律规范、禁止性法律规范。情态操作语是反映法律规范本质的核心词。因此,情态操作语在汉语立法语篇的研究中具有重要意义。立法语篇情态系统翻译的关键在于译者是否准确传达了法律条文所规定的权利、义务和禁止。本文运用系统功能语法的情态系统理论,基于中国法律法规汉英平行语料库（大陆子库）,分析中国立法语篇情态操作语英译中存在的问题。本研究从频率、情态值和归一度三个方面分析现行汉语立法语篇及其英译版...
