劳务派遣退回法律制度研究
[Abstract]:Labor dispatch is a non-standard employment mode which is separated from employment. There are two main parts of the standard employment mode: the employer and the laborer, but the labor dispatch is not the same as the standard employment mode, which includes the labor dispatch unit, the employment unit and the tripartite subject of the dispatched laborer. Because of its complicated tripartite relationship, the return of dispatched workers and the unilateral release of labor dispatch become the two most important links in labor dispatch, and it is of great significance to distinguish them correctly. In recent years, labor dispatch in our country is booming and has a trend of replacing standard labor. The development of labor dispatch also brings a large number of labor dispatch disputes. In this case, labor dispatch needs more comprehensive laws to regulate. However, as far as the most important return of labor dispatch is concerned, the labor legislation of our country overregulates the return conditions of employment units and the legal provisions are vague, neglecting the essence of the existence of labor dispatch lies in its flexibility of employment. And mixing the return of employment units with the unilateral dissolution of labor dispatch units in the same legal provisions not only makes the conditions of return ambiguous, but also confuses the procedures of returning work units with the unilateral lifting procedures of labor dispatch units. More conducive to the dispatch of labor units and employment units against the legitimate rights and interests of dispatched workers momentum. Accordingly, labor dispatch returns did not go on the road of benign development. Based on 145 cases collected from the second instance of labor dispatch return dispute, this paper adopts the empirical research method to cancel the labor contract compensation according to the law. The three litigation requests of restoring labor relations and restoring employment relations, and the legality of the reasons for the return of employment units, are analyzed in detail from the two aspects of "special period" to explain the court hearing the cases of labor dispatch return. Through the analysis and research on the dispute of labor dispatch return, some suggestions are put forward to perfect the legal system of labor dispatch return in our country.
