大学生法治精神培育研究

【摘要】：大学生法治精神是指大学生在先天生理基础上,历经后天社会法治环境影响和高校法治教育作用,通过法律学习内化和行为实践而逐渐形成的相对稳定的基本品质和活力面貌。大学生作为未来社会主义建设的中坚力量,法治精神的成熟与完善不仅与自身价值的实现紧密相连,更关乎到国家的发展进程。因此,在当下依法治国与社会主义法治社会建设的背景下,大学生法治精神培育的重要性受到越来越多专家学者们的重视。然而,在大学生法治精神培育过程中,法治精神各要素是如何运行的,如何使大学生法治精神培育取得最佳效果却没有得到系统研究。本文以大学生法治精神的基本内涵和主要功能为切入点,尝试明晰大学生法治精神培育的结构要素,在此基础上通过优化其运行机制和运作模式以提升大学生法治精神培育的有效性、针对性和实效性。本论文主要从以下六个部分加以展开:第一部分,梳理与述评大学生法治精神及培育问题的研究现状,阐释大学生法治精神培育问题研究的思路与方法。第二部分,辨析法律、法制与法治等相关概念,界说大学生法治精神的含义、要素与特征。第三部分,阐述大学生法治精神对于大学生成长成才的主要功能,主要基于人文素质视角、法律素质视角与社会素质视角。第四部分,阐释大学生法治精神培育的结构要素,主要包括培育的主体、培育的内容、培育的载体以及培育的环境。第五部分,论述大学生法治精神培育的运行机制,包括其基本特征、内在过程运行机制与外在过程运行机制。第六部分,讨论大学生法治精神培育的运作模式,主要通过优化培育目标、遵循培育原则、疏通培育途径以及创新培育方法。
[Abstract]:The spirit of university students' rule of law refers to the relatively stable basic quality and vitality gradually formed through the internalization of law learning and the practice of behavior, on the basis of innate physiology, through the influence of the acquired social legal environment and the role of the rule of law education in colleges and universities. College students as the backbone of socialist construction in the future, the maturity and perfection of the spirit of rule of law is not only closely linked to the realization of their own value, but also related to the development process of the country. Therefore, under the background of ruling the country according to law and building a socialist society under the rule of law, more and more experts and scholars pay more and more attention to the importance of cultivating the spirit of university students' rule of law. However, in the process of cultivating the spirit of the rule of law of college students, there is no systematic study on how the elements of the spirit of rule of law work, and how to make the best effect of the cultivation of the spirit of rule of law for college students. Based on the basic connotation and main functions of the spirit of ruling by law of college students, this paper tries to clarify the structural elements of cultivating the spirit of ruling by law of college students. On this basis, through optimizing its operation mechanism and operation mode to enhance the effectiveness, pertinence and effectiveness of the cultivation of university students' spirit of rule of law. This thesis mainly starts from the following six parts: the first part, combs and reviews the university student rule of law spirit and the cultivation question research present situation, explains the university student rule of law spirit cultivation question research thought and the method. The second part, discriminates and analyzes the law, the legal system and the rule of law and other related concepts, defines the university student rule of law spirit's meaning, the essential factor and the characteristic. In the third part, the main functions of the spirit of rule of law for college students' growth and development are expounded, which are mainly based on the perspectives of humanistic quality, legal quality and social quality. The fourth part explains the structural elements of the cultivation of the spirit of university students' rule of law, including the main body of cultivation, the content of cultivation, the carrier of cultivation and the environment of cultivation. The fifth part discusses the operating mechanism of the cultivation of the spirit of university students' rule of law, including its basic characteristics, internal process operation mechanism and external process operation mechanism. The sixth part discusses the operating mode of cultivating the spirit of ruling by law of college students, mainly through optimizing the cultivation goal, following the cultivation principle, unblocking the cultivation way and innovating the cultivation method.
