以不动产信托登记为视角论房地产投资信托基金的法律瓶颈

【摘要】：为解决不动产信托登记有名无实的尴尬问题和房地产投资信托基金登记的法律瓶颈,通过对不动产信托登记与不动产物权登记进行文献分析,发现两大法系对信托财产权属的立法存在巨大差异,提出借鉴中国台湾地区的相关立法,在不动产物权登记的基础上,对不动产信托登记的效力、主体、事项提出相关立法建议,对房地产投资信托基金登记提出适当进行技术性调适的建议。
[Abstract]:In order to solve the real estate trust registration in the legal bottleneck embarrassment and real estate investment trust registration, the registration of real estate trust and real property registration documents analysis, it is found that there are great differences in the legislation on trust property ownership of the two legal systems, proposed legislation in Taiwan China, in based on the real estate registration, the real estate trust registration effect, the subject, put forward relevant legislative proposals on the matter, the real estate investment trust fund registration to provide appropriate technical adjustment suggestions.
