规制抑或调控:我国房地产市场的国家干预

【摘要】:近十年来国家和地方对房地产市场的行政干预措施运用了各类规制手段、影响到诸多市场主体的权利,然而,运用一般的规制理论却很难评价这些措施的得失及其在法治层面的缺陷。究其原因,在于学界尚未就作为规制对象的我国房地产市场和作为规制目的的房地产市场与宏观经济关系,以及国家在经济活动中的主导地位对房地产规制产生的影响三者展开充分的认识和研究。我国房地产市场规制具有规制者与被规制者重合、微观产业规制与宏观经济高度相关的特殊之处。因此,打破规制者与被规制者的重合、客观评价规制机关的独立性、建立稳定的规制框架以及提高可负担性住房权利的地位等视角应在规制方案设计时受到重视。
[Abstract]:In the past ten years, the administrative intervention measures of the state and the local authorities in the real estate market have applied various regulatory measures, which have affected the rights of many market subjects, however, However, it is difficult to evaluate the gains and losses of these measures and their defects in the level of rule of law by using the general regulation theory. The reason lies in the fact that there is no relationship between the real estate market, which is the object of regulation, and the real estate market, which is the object of regulation, and the macro-economy. And the influence of the leading position of the state in the economic activities on the real estate regulation is fully understood and studied. The regulation of the real estate market in China has the special features of the superposition of the regulators and the regulated ones, and the high correlation between the micro industrial regulation and the macro economy. Therefore, the perspective of breaking the coincidence between the regulator and the regulated, objectively evaluating the independence of the regulatory body, establishing a stable regulatory framework and improving the status of affordable housing rights should be paid attention to in the design of the regulatory scheme.
