开发商和业主签订地上停车位的协议是否有效

【摘要】:正问题某小区业主甲与房地产开发商乙签订了《车位使用协议》,约定小区内第5号地上停车位由甲长期独占使用,甲向乙支付了2万元车位使用费。该车位系经规划审批建设的停车位,铺装了植草砖,占地面积按50%计入绿化面积。后业委会主张该停车位为全体业主共有。请问:甲乙签订的这份车位使用协议是否有效?解答一、本案中第5号停车位的权属性质
[Abstract]:The owner of a residential area and real estate developer B signed a "parking space use agreement", agreed that the residential area No. 5 above ground parking space by a long-term exclusive use, A paid 20,000 yuan to B parking fees.
