大连市房地产评估监管问题及对策研究

【摘要】:房地产评估是房地产中介的组成部分,作为维持房地产市场公平公正的一种重要手段,在西方国家有着百年的历史。我国现代房地产评估行业兴起于20世纪80年代,近年来我国房地产评估业发展迅速,伴随着法律法规的不断完善,业务量的增加,评估标准逐步健全;我国评估执业更加规范,评估质量也明显提高。经过多年的摸索和实践,初步探索出政府监管为主,结合行业自律社会监督的监管模式,逐渐形成了开放公正、监管有序的市场秩序。因为我国房地产评估起步较晚,目前关于房地产评估还缺乏较为系统的论述,对房地产评估监管领域的研究更是一个较新的领域,目前关于房地产评估监管方面的研究更多的是对现实的阐述,缺少科学的深刻分析。 伴随着房地产评估行业的发展,行业监管问题也日益显现出来。虽然大连房地产评估行业在国内属于较为超前的城市,但是相较于国内外发达国家和地区的监管模式,仍有较大差距,因此在结合现实背景的基础上,国内外发达国家和地区的先进经验对完善大连市房地产评估监管制度有着借鉴意义。 大连现行监管模式为政府监管行业自律,但是由于体制等历史问题,并未完全发挥此模式的优势;现在大连房地产评估监管主要存在着政府监管多元化,行业独立性差,法律法规不完善等问题,本文通过分析大连房地产评估监管现状分析,结合国内外先进经验,论证出大连市仍然适合现行的政府监管行业自律监管模式;在此基础上对大连市房地产评估市场从监管主体,监管客体,监管手段标准等几个方面提出对策和意见。
[Abstract]:As an important means to maintain the fairness and fairness of real estate market, real estate evaluation is a component of real estate intermediary, and has a history of one hundred years in western countries. China's modern real estate evaluation industry rose in the 1980s. In recent years, China's real estate evaluation industry has developed rapidly. With the continuous improvement of laws and regulations, the increase of business volume, the evaluation standard is gradually improved. The quality of the evaluation is also significantly improved. After many years of exploration and practice, this paper preliminarily explored the supervision mode of government supervision, and combined with the supervision mode of self-discipline social supervision of the industry, gradually formed the market order of open and fair and orderly supervision. Because of the late start of real estate evaluation in our country, there is still a lack of systematic discussion on real estate evaluation at present, and the research on the field of real estate evaluation supervision is a relatively new field. At present, the research on the supervision of real estate evaluation is more about the elaboration of reality, lacking of scientific and profound analysis. Along with the development of real estate appraisal industry, the problem of industry supervision also appears day by day. Although Dalian Real Estate Appraisal Industry is a leading city in China, there is still a big gap between the domestic and foreign developed countries and regions, so on the basis of combining the realistic background, The advanced experience of developed countries and regions at home and abroad has reference significance for perfecting the supervision system of real estate evaluation in Dalian. The current supervision mode of Dalian is the self-discipline of the government supervision industry, but because of the historical problems such as the system, it does not give full play to the advantages of this model. Through analyzing the current situation of Dalian real estate evaluation and supervision, combining the advanced experience at home and abroad, this paper demonstrates that Dalian is still suitable for the current self-regulatory mode of government supervision industry. On this basis, this paper puts forward some countermeasures and suggestions on Dalian real estate evaluation market from the aspects of supervision subject, supervision object, supervision means standard and so on.
