房地一体化土地管理模型设计

【摘要】:土地和房屋是人类赖以生存和发展的基础。考虑到土地和房屋在现实中的不可分割性,在房屋发生转让或者抵押时,该房屋所占用范围内的土地也应该同时进行转让或者抵押,反之亦然。另外,从土地和房屋自然属性上的完整性考虑,土地使用权证以及房屋所有权证也应该是统一发放的。再者,从立法角度看,在许多法律法规中都提出了实行房地一体化管理的相关规定,,特别是针对登记工作。但是,目前在我国的大部分地区,土地和房屋仍然实行的是分开管理的模式,而这样的现状为房地产市场的发展、交易过程造成了诸多的问题。 针对我国房地一体化管理的问题,本文试图从技术角度提出相应的解决方案。根据Peter van Oosterom教授提出的土地管理成熟度模型(Land Administration Maturity Model(LAMM)),本文主要是在标准化的阶段来解决一体化的问题,具体引入了土地管理领域模型(Land Administration Domain Model(LADM)-ISO19152)的理论。在此理论的基础上,本文以房地一体化为重点,完成了对我国土地管理领域模型(LADM CountryProfile for China, CNLADM1)的设计。 本研究首先以相关法律法规为基础,分析得到了一系列针对房地一体化管理的法律约束。同时,土地和房屋数据库现状结构的分析则是以重庆市为例,具体参照《重庆市城镇地房籍数据库标准》(以下简称《标准》)来进行。随后,在分析研究的基础上,参照LADM标准来设计我国的土地管理领域模型(CNLADM)。最后,则是通过建立评价体系来对CNLADM进行相应的评价。 总的来讲,本文的目标主要是以房地一体化为重点,完成对我国土地管理领域模型的设计。鉴于本文的重点是房地数据库的一体化,故而该CNLADM模型主要涵盖了我国土地以及房屋管理领域两方面的相关内容。
[Abstract]:Land and housing are the basis for human survival and development. Considering the indivisibility of land and house in reality, when the house is transferred or mortgaged, the land occupied by the house should be transferred or mortgaged at the same time, and vice versa. In addition, from the integrity of the natural attributes of land and houses, land use warrants and building ownership certificates should also be issued uniformly. Furthermore, from the legislative point of view, in many laws and regulations, the implementation of the integrated management of premises related provisions, especially for registration. However, at present, in most areas of our country, land and housing are still managed separately, and this situation has caused many problems for the development of the real estate market and the transaction process. Aiming at the problem of the integrated management of our country's premises, this paper tries to put forward the corresponding solutions from the technical point of view. According to the land Administration maturity model proposed by Professor Peter van Oosterom, this paper mainly deals with the problem of integration in the stage of standardization, and introduces the theory of Land Administration Domain Model LADM-ISO 19152. On the basis of this theory, this paper focuses on the integration of premises and completes the design of land management domain model in China (CNLADM1). Firstly, based on the relevant laws and regulations, a series of legal constraints on the integrated management of premises are obtained. At the same time, the analysis of the present structure of land and house database takes Chongqing as an example, referring specifically to "Chongqing Urban Land and Housing Database Standard" (hereinafter referred to as "Standard"). Then, on the basis of analysis and research, the land management domain model of China is designed with reference to LADM standard. Finally, the evaluation system is established to evaluate CNLADM. In general, the aim of this paper is to complete the design of land management model in our country, focusing on the integration of premises. Since the emphasis of this paper is the integration of premises database, the CNLADM model mainly covers two aspects of land and housing management in China.
