农村被征用土地和拆迁房屋评估方法比较研究

【摘要】:随着我国城市化进程和新农村的建设,征地已经成为我国的普遍现象。但与此同时也出现了很多问题。比如说征用农用地价格补偿不合理,拆迁农村房屋没有考虑到农村居民的社会保障,低估了农用地和农村房屋的价格。评估理论和实践的滞后,民群众合法权益的有效保护。所以本文分别从征用农用地和拆迁农村房屋的角度出发,找到适合这两种情况的评估方法,具有极大的实践意义。 对于农征地的评估方法,通过采用两种或两种以上方法对农用地征用价格进行评估,并结合当地实际情况对不同评估结果进行分析,确定最后的估价结果。在本文中主要采用的是用社会价值量和城镇基准地价进行农征地的评估,得出的最终结果进行比较发现接近实际征用价格,说明了这两种方法的可行性。 对于农村拆迁房屋的评估,主要是对照城镇拆迁房屋的评估方法,最普遍和适用的是市场比较法。但是在采用市场比较法的过程中我们发现,在影响可比实例的因素修正时,带有较大的主观性。为了避免这种情况,在本文中引入了模糊数学模型,运用德尔菲法(Delphi)即专家打分法确定特征因素的隶属函数值,这样更能客观的求出待估房屋的价格,增加了精确性,对于改进市场比较法具有重要的意义。 文章分为以下几个部分:第一部分为引言,介绍了本文的引言、研究意义以及逻辑框架。第二部分为文献综述,回顾了国内外关于评估农用地和房地产的历史发展进程,对于国外的农用地评价体系和房屋定量估价方法值得我们学习,并且用在我国的实际情况中;第三部分介绍了农用地分等定级的标准以及农用地估价的方法,着重介绍了分等定级的步骤以及与农用地估价的关系,并且介绍了关于农用地价格的几个概念,更好的说明了农用地价格的构成。第四部分通过举例说明农用地的估价方法并且做出了科学的比较。第五部分论述了拆迁房屋的估价方法以及改进的市场比较法,并引进了模糊数学模型,模糊集对认知不确定的模糊概念和对象有着很好的处理效果,采用定量的计算房屋的价格更加合理,对于在实际情况下对拆迁房屋的补偿提供了很好的依据。运用改进的市场比较法进行案例分析并且和传统的市场比较法进行了比较分析;第六部分对文章进行了总结,提出了建议,并且说明了不足之处。 我们可以看出对于农征地和拆迁房屋的估价方法我们有很多选择,但以往的选择通常是以定性分析为主,通过对估价方法的改进,引入数学模型,定量的评估农征地和拆迁房屋的价格,对于补偿价格奠定了一个科学合理的基础,对于保障农民的权利以及我国经济的纵向发展具有极大的意义。
[Abstract]:With the process of urbanization and the construction of new countryside, land expropriation has become a common phenomenon in China. But at the same time, there are also a lot of problems. For example, the price compensation for expropriation of agricultural land is unreasonable, the demolition of rural houses does not take into account the social security of rural residents, and the price of agricultural land and rural houses is underestimated. Evaluation theory and practice lag, the effective protection of the legitimate rights and interests of the masses. Therefore, from the angle of expropriation of agricultural land and demolition of rural houses, this paper finds the evaluation methods suitable for these two situations, which has great practical significance. For the evaluation method of land expropriation, two or more methods are used to evaluate the expropriation price of agricultural land, and different evaluation results are analyzed according to the local conditions, and the final evaluation results are determined. In this paper, we mainly use the social value and the standard land price to evaluate the land expropriation. The final results are close to the actual expropriation price, which shows the feasibility of these two methods. The evaluation of rural house demolition is mainly compared with the evaluation method of urban house demolition, and the most common and applicable method is the market comparison method. However, in the process of adopting market comparison, we find that there is more subjectivity in the correction of factors affecting comparable examples. In order to avoid this kind of situation, the fuzzy mathematics model is introduced in this paper, and the membership function value of characteristic factor is determined by using Delphi method (Delphi), that is, expert scoring method, so that the price of house to be estimated can be calculated objectively and the accuracy is increased. It is of great significance to improve the market comparison method. The article is divided into the following parts: the first part is the introduction, the significance of the research and the logical framework. The second part is literature review, reviewing the historical development process of appraising agricultural land and real estate at home and abroad. The evaluation system of agricultural land and the method of house quantitative evaluation abroad are worth studying, and used in the actual situation of our country. The third part introduces the standard of agricultural land gradation and the method of agricultural land evaluation, especially introduces the steps of grading and the relationship with agricultural land evaluation, and introduces several concepts about agricultural land price. A better explanation of the composition of agricultural land prices. The fourth part illustrates the evaluation method of agricultural land and makes a scientific comparison. The fifth part discusses the evaluation method of the house demolition and the improved market comparison method, and introduces the fuzzy mathematical model. The fuzzy set has a good effect on the fuzzy concept and object of cognitive uncertainty. The quantitative calculation of housing price is more reasonable, which provides a good basis for the compensation of house demolition. The improved market comparison method is used for case analysis and comparative analysis with the traditional market comparison method. The sixth part summarizes the article, puts forward some suggestions, and explains the shortcomings. We can see that we have a lot of choices for the evaluation methods of land expropriation and house demolition, but the former choice is usually qualitative analysis, through the improvement of the evaluation method, the mathematical model is introduced. The quantitative evaluation of the price of land requisition and house demolition lays a scientific and reasonable foundation for the compensation price and is of great significance to the protection of farmers' rights and the vertical development of our country's economy.
