浅谈房地产关系对房地行政管理体制之影响

【摘要】：房地产关系包括权利归属关系与交易关系两个方面。对于房地产权属关系,大陆法系国家主要有结合主义与分别主义两种模式;对于房地产交易关系,各国立法体例又存在一体交易与分别交易两种模式。结合《物权法》的相关规定,借鉴国外立法实践,分析我国现行房地分别主义与一并处分原则的现状,探讨其对房地行政管理体制的改革和完善的影响,并为顺应统一房地产管理之时代趋势提出建议。
[Abstract]:Real estate relationship includes two aspects: ownership relationship and transaction relationship. For the real estate ownership relationship, there are two modes in continental law countries: unionism and separatism; for real estate transaction, there are two models in the legislation of each country: integrated transaction and separate transaction. Combined with the relevant provisions of the Real right Law, this paper analyzes the present situation of the principle of separation of premises and the principle of disposition together, and discusses its influence on the reform and perfection of the administrative system of the premises, using the foreign legislative practice for reference, and analyzes the present situation of the principle of separation of premises in China. And in order to conform to the trend of unified real estate management put forward suggestions.
