我国商品房预告登记管理问题研究

【摘要】:近年来,随着房地产市场的不断发展,由房地产纠纷引发的社会矛盾也随之增多。随着2007年10月1日《物权法》的实施商品房预告登记被运用到了商品房的管理当中。商品房预告登记管理制度作为房地产市场管理的一项基本制度,对于规范商品房预售(购)交易双方的行为,保障预购房人的合法权益,促进房地产市场平稳健康发展具有十分重要的意义。 本文在阅读大量国内外关于预告登记管理文献资料的基础,通过分析预告登记的管理现状,列举预告登记管理存在的主要问题。结合我国预告登记管理制度运行状况,从管理学、产权理论等理论角度出发,提出解决我国预告登记管理制度存在的问题对策 我国预告登记管理制度建立才几年来,从运行的整体状况来看,效果良好,也为我国的商品房发展提供了一个很好的管理服务体系。但存在的问题也不容忽视,诸如预告登记适用的范围太狭窄;预告登记管理人员素质参差不齐;预告登记管理的法律效力的局限性;预告登记的赔偿制度不明确等问题。如何在新形势下,以《物权法》的颁布实施为契机,加快解决我国预告登记管理制度存在问题的步伐,使预告登记更好的服务于我国现代化建设,更好的服务于中华民族的伟大复兴,成为保障商品房市场健康发展的重要工具。本文主要从我国商品房预告登记管理的现状论述,并就我国预告登记管理存在的问题进行了挖掘。最后提出了包括从健全立法、改进管理方法和提高工作人员综合素质三方面的对策和建议。
[Abstract]:In recent years, with the continuous development of the real estate market, the social contradictions caused by the real estate disputes have also increased. With the implementation of the Real right Law on October 1, 2007, the advance registration of commercial housing has been applied to the management of commercial housing. As a basic system for the management of the real estate market, the system of management of advance registration of commercial housing protects the legitimate rights and interests of pre-buyers in order to regulate the behavior of both parties to the pre-sale (purchase) transaction of commercial housing, It is of great significance to promote the steady and healthy development of the real estate market. On the basis of reading a large number of documents on the management of advance notice registration at home and abroad, this paper analyzes the present situation of the management of advance notice registration, and lists the main problems existing in the management of advance notice registration. According to the operating situation of the management system of advance notice registration in our country, from the angle of management and property right theory, this paper puts forward some countermeasures to solve the problems existing in the management system of advance notice registration in our country, which has only been established in the past few years. From the overall operation of the situation, the effect is good, but also for the development of commercial housing in China to provide a good management service system. However, the existing problems can not be ignored, such as too narrow scope of application of advance notice registration, uneven quality of management personnel of advance notice registration, limitation of legal effect of advance notice registration management, unclear compensation system of advance notice registration and so on. Under the new situation, taking the promulgation and implementation of the property Law as a turning point, how to speed up the steps of solving the problems existing in the management system of notice registration in our country, so as to make the notice registration serve the modernization construction of our country better, Better serve the great rejuvenation of the Chinese nation and become an important tool to ensure the healthy development of the commercial housing market. This paper mainly discusses the present situation of the management of commercial house notice registration in our country, and excavates the problems existing in the management of the notice registration in our country. Finally, the countermeasures and suggestions are put forward from three aspects: perfecting legislation, improving management method and improving staff's comprehensive quality.
