城乡一体化建设的法制保障研究

【摘要】：中国正处于社会转型时期,新的社会发展模式和机制正在重新构建,在由城乡二元社会向城乡一体化的转型过程中,“二元经济结构”成为阻碍城乡一体化发展的“瓶颈”,制约了我国社会经济的可持续发展。城乡一体化建设中需要什么样的法律制度,如何构建与城乡一体化相适宜的法制保障机制?本文在分析城乡二元结构及其法制框架的基础上,从四个方面探讨了构建城乡一体化中法制保障体系问题。全文共分为三部分,其逻辑结构与具体内容如下：第一部分是城乡二元社会及其法制状态。首先阐释城乡二元社会结构的由来,在此基础上分析城乡二元社会经济结构的历史演化过程,总结出城乡二元社会下的独特法制状态。第二部分是城乡一体化及其法制需求。解释城乡一体化的内涵、特征,分析制约城乡一体化的原因,由此引导出城乡一体化的法律制度需求。第三部分是城乡一体化的法制保障与建设。此部分为全文重点。分别从构建城乡一元化的户籍管理制度、着力推进土地制度改革的法制建设、城乡一体化金融法律制度的建设和城乡一体化中养老保障制度的法律建设四个主要方面共同构建我国城乡一体化中所涉及的法律制度。
[Abstract]:China is in a period of social transformation, and new social development models and mechanisms are being rebuilt. In the process of transformation from urban-rural dual society to urban-rural integration, "dual economic structure" has become a "bottleneck" that hinders the development of urban-rural integration, which restricts the sustainable development of China's social economy. What kind of legal system, How to construct the legal guarantee mechanism suitable for the integration of urban and rural areas? Based on the analysis of the dual structure of urban and rural areas and its legal framework, this paper discusses the construction of legal security system in urban-rural integration from four aspects. The paper is divided into three parts, its logical structure and specific contents are as follows:. The first part is the dualistic society in urban and rural areas and its legal system. Firstly, it explains the origin of dualistic social structure in urban and rural areas, and then analyzes the historical evolution process of dualistic social and economic structure in urban and rural areas. Summarize the unique legal state under the dual society of urban and rural areas. The second part is the urban-rural integration and its legal needs, explaining the connotation and characteristics of urban-rural integration, analyzing the reasons that restrict the urban-rural integration, thus leading to the legal system needs of urban-rural integration. The third part is the legal guarantee and construction of urban-rural integration. The construction of financial legal system of urban-rural integration and the legal construction of old-age security system in urban-rural integration are four main aspects to construct the legal system involved in the integration of urban and rural areas in China.
