法治与德治的互动:规则意识培育的双重维度

【摘要】：规则意识是市场经济与民主法治发展的精神动力,是新时期道德秩序与法治秩序的内在支撑,是现代法治文明和道德文明的主要价值理念。规则本身包含制度层面的法律规则和道德层面的社会公德。将规则意识置于法治社会框架中,将规则意识培育放在如何满足主体需要和人的全面发展角度来考量,使规则所体现的法理要求与伦理要求相一致,在底线意义上维系并推动整个社会法治与道德水平的提升。
[Abstract]:Rule consciousness is the spiritual motive force of the development of market economy and democratic rule of law. It is the internal support of the moral order and the rule of law in the new period. It is the main value concept of the modern rule of law civilization and moral civilization. The rule itself contains the legal rules of the system level and the social morality in the moral level. The cultivation of rule consciousness is considered in the perspective of how to meet the needs of the main body and the all-round development of people, to make the legal requirements embodied in the rules consistent with the ethical requirements, and to maintain and promote the promotion of the rule of law and the moral level of the whole society in the sense of the bottom line.
