村规民约法治化的动力机制研究

【摘要】：当代中国基层民主自治制度下的村规民约,沿袭着传统规约的乡土特色和自治特色,部分内容与国家法律法规相冲突,影响着村庄的法治化进程。在法治社会建设大背景下,玉溪市红塔区A村着力探索地方习俗与法的融合,修订完善村规民约,开启了村规民约法治化的新篇章。考察发现,国家制度的变迁、群众利益诉求的表达、党委政府对群众诉求的积极回应、多部门协同支持、村组干部及村民的有效参与以及村庄文化与时俱进的变迁等多方因素共同作用,成为推动村规民约法治化的强大动力。
[Abstract]:The village rules and regulations under the grass-roots democratic autonomy system in contemporary China follow the local and autonomous characteristics of the traditional statutes. Some of the contents conflict with the laws and regulations of the state and affect the process of ruling by law in villages. Against the background of the construction of a society under the rule of law, Village A of Hongta District of Yuxi City tries to explore the fusion of local customs and laws, revise and perfect the rules of the people, and open a new chapter of the rule of law by the rule of law. The investigation found that the changes of the state system, the expression of the interests of the masses, the positive response of party committees and governments to the demands of the masses, and the concerted support of various departments, The effective participation of village cadres and villagers, as well as the changes of village culture with the times and other factors, have become a powerful driving force to promote the rule of law in villages according to rules of law.
