马克思主义垄断理论与反垄断法治建设研究

【摘要】：反垄断法治建设是现阶段进行经济建设所面临的重大课题。马克思主义垄断理论和反垄断法治建设之间具有重要联系。本文着重从以下三大方面对二者关系进行了论述: 首先,社会主义市场经济的复杂性和资本主义垄断理论的局限性。公有和私有价值观念的冲突,计划和市场发展理念的冲突,经济发展和法治滞后现实状况的冲突,发展目的的利己性和利公性的冲突等多个方面的综合因素,决定了我国社会主义市场经济本身具有区别于资本主义市场经济的复杂性;同时资本主义垄断理论的经济基础、文化基础及其对于垄断的片面认识等多方面内容,也注定了运用其指导中国特色社会主义市场经济具有资本主义垄断理论自身难以克服的局限性。其次,马克思主义垄断理论的科学性和对社会主义市场经济的适用性。马克思主义垄断理论是一种经过扬弃并且不断进行中国化的垄断理论,其不仅认识到垄断与竞争并存的现实,而且看到了非正常竞争对经济发展所产生的危害,更创造性地提出了垄断作用二重性理论。理论本身的这些特性决定了其与资本主义垄断理论之间具有本质的区别。社会主义市场经济的复杂性,资本主义垄断理论的局限性和马克思主义垄断理论的科学性以及马克思主义垄断理论和社会主义市场经济之间所具有的共同社会属性,使得马克思主义垄断理论对于指导中国特色社会主义市场经济建设来说,具有很强的适用性。再次,以马克思主义垄断理论为指导推进中国的反垄断法治建设。马克思主义垄断理论与我国的反垄断法治建设之间是相辅相成的。在当前经济企稳复苏的特殊时期,正确理解马克思主义垄断理论的实质内涵,正确认识加强反垄断法治建设的重要性是经济发展的必然要求。马克思主义垄断理论指导着我国反垄断法治建设,并直接体现在了我国反垄断法的制定和实施过程中;同时我国反垄断法治建设也从实践的角度对这一理论进行着不断丰富和完善。
[Abstract]:The construction of anti-monopoly rule of law is an important subject for economic construction at this stage. Marxist monopoly theory and anti-monopoly rule of law have an important connection. This paper focuses on the following three aspects of the relationship between the two discussed: Firstly, the complexity of socialist market economy and the limitation of capitalist monopoly theory. The conflict between public and private values, the conflict between the concept of plan and market development, the conflict between economic development and the lag of the rule of law, the conflict between the self-interest and the commonality of the purpose of development, and so on. It is decided that the socialist market economy of our country is different from the complexity of the capitalist market economy, and at the same time, the economic foundation, the cultural basis and the one-sided understanding of the monopoly of the capitalist monopoly theory and so on. It is also doomed to use it to guide the socialist market economy with Chinese characteristics has the limitations of the capitalist monopoly theory itself. Secondly, Marxist monopoly theory is scientific and applicable to socialist market economy. Marxist monopoly theory is a kind of monopoly theory which has been sublimated and continuously carried out in China. It not only recognizes the reality of monopoly and competition, but also sees the harm of abnormal competition to economic development. The theory of duality of monopoly is put forward more creatively. These characteristics of the theory itself determine the essential difference between the theory and the capitalist monopoly theory. The complexity of socialist market economy, the limitation of capitalist monopoly theory, the scientific nature of Marxist monopoly theory and the common social attribute between Marxist monopoly theory and socialist market economy, The theory of Marxist monopoly has strong applicability to guide the construction of socialist market economy with Chinese characteristics. Thirdly, the construction of anti-monopoly rule of law in China is promoted under the guidance of Marxist monopoly theory. The Marxist monopoly theory and the anti-monopoly rule of law construction in our country complement each other. In the special period of economic stabilization and recovery, it is an inevitable requirement for economic development to correctly understand the essential connotation of Marxist monopoly theory and correctly understand the importance of strengthening the construction of anti-monopoly rule of law. Marxist monopoly theory guides the construction of anti-monopoly rule of law in our country, and it is directly reflected in the process of making and implementing anti-monopoly law in our country. At the same time, the construction of anti-monopoly rule of law in China is enriching and perfecting the theory from the point of view of practice.
