【摘要】：随着中国城市化进程的不断加快,城市成为人类的主要聚居地。一个城市往往是一个地区的政治、经济、文化中心。城市的建设和发展中,城市规划起着决定性的作用。城市规划不仅决定了城市的性质、发展规模和发展目标,而且作为一项公共政策影响着生活于其中的每一位市民。因此如何科学地编制城市规划,合理引导城市有序发展,是一个城市必须面对的问题。一个城市如何建设、如何发展,城市规划是根本,城市规划决策是关键,而城市规划决策法治化是保证。目前我国城市规划决策虽已形成一定的法治机制,但仍不完善,常常导致城市规划决策失误,使城市建设混乱,造成资源浪费。如何避免城市规划决策失误,使城市规划决策有章可循,探索城市规划决策走向法治化的途径是必由之路。本文通过分析城市规划及其决策的特点,分析城市规划决策失误的原因,研究城市规划决策法治化的涵义,以探索城市规划决策法治化的实现途径。提出通过建立和完善城市规划编制、规划管理和规划实施过程中的相关法律法规、规范和技术标准等,进一步规范城市规划的执法行为,通过加强对违法行政行为的问责力度,使城市规划决策有法可依、有法必依、执法必严、违法必究,从而推动城市规划决策走向法治化。
[Abstract]:With the development of urbanization in China, cities have become the main human settlements. A city is often the political, economic, and cultural center of a region. Urban planning plays a decisive role in the construction and development of cities. Urban planning not only determines the nature, scale and goal of a city, but also affects every citizen living in it as a public policy. Therefore, how to scientifically formulate urban planning and guide the orderly development of cities is a problem that a city must face. How to build and develop a city, urban planning is fundamental, urban planning decision is the key, and the rule of law of urban planning decision is the guarantee. Although a certain legal mechanism has been formed in urban planning decision-making in our country, it is still imperfect, which often leads to mistakes in urban planning decisions, chaos in urban construction and waste of resources. How to avoid the mistakes of urban planning decision-making and make the urban planning decision have rules to follow, it is necessary to explore the way of urban planning decision-making to rule by law. By analyzing the characteristics of urban planning and its decision making, this paper analyzes the causes of urban planning decision-making errors, studies the meaning of urban planning decision rule by law, and explores the way to realize urban planning decision rule by law. Through the establishment and improvement of urban planning, planning management and implementation of relevant laws and regulations, norms and technical standards to further standardize urban planning law enforcement, through the strengthening of illegal administrative acts of accountability, The urban planning decision should be governed by the law, the law must be obeyed, the law should be strictly enforced and the violation of the law must be prosecuted, thus promoting the urban planning decision to be ruled by law.
