《中华人民共和国仲裁法》英译问题探析

【摘要】：本文结合法律翻译基本原则和美国《统一仲裁法》、英国《仲裁法》等英美国家法律文件的用词造句特点,对《中华人民共和国仲裁法》英译版本进行了分析,发现该译本存在若干问题,主要表现在:(1)术语翻译不准确;(2)违背一致性原则;(3)表达累赘拖沓;(4)忽视借用英语国家相关法律惯用语表达导致的误译。在对这些问题进行分析的基础上,提出了修改意见以及提高我国法律文件英译质量的建议。
[Abstract]:Based on the basic principles of legal translation and the word-making features of American and British legal documents such as the uniform Arbitration Law and the British Arbitration Law, this paper makes an analysis of the translated versions of the Arbitration Law of the people's Republic of China. It is found that there are some problems in the translation. This is mainly manifested in: (1) inaccurate translation of terms / 2) violation of the principle of consistency. (4) neglect of misinterpretation caused by borrowing relevant legal idioms from English-speaking countries. On the basis of an analysis of these problems, Some suggestions are put forward to improve the quality of English translation of Chinese legal documents.
