知识产权类判决书英译的翻译转移研究：信息桥视角

　　随着全球化进程的深入,我国与国际社会的法律交流不断增加。就知识产权保护而言,各国保护知识产权的呼声日益高涨。多边贸易往来导致的跨国知识产权纠纷的案例也比比皆是。因此,如何有效地促进知识产权相关法律的交流变得尤为重要。翻译转移是翻译活动中常见的一种现象。目前国内对翻译转移的研究主要集中在理论研究和文学翻译中,对判决书中的翻译转移研究较少。本文尝试将翻译转移和判决书结合起来,在信息桥模型的指导下,旨在探讨知识产权类判决书中的翻译转移现象。为此,本文提出了三个研究问题:1.在知识产权类判决书英译之中,翻译转移的具体表现形式有哪些?2.这些翻译转移的产生受到哪些因素的影响?3.怎样去评判这些翻译转移是否合适?本文选取了6篇知识产权类判决书及其英译本作为语料,结合法律语篇信息分析,对其进行信息成分的标注,比较原文和译文信息成分的差别。本文从宏观语言和微观信息层面总结了知识产权类判决书汉译英时发生的翻译转移,研究发现翻译转移在信息层面主要表现为:信息减少、信息增加、信息更换、信息移位。在语言层面体现在词汇、句法和语篇方面。在信息桥理论的指导下,本文指出影响翻译转移的因素主要是社会文化中的意识形态,...
