【摘要】：本论文是美国最高法院的一份判决书的翻译报告。现今,中国政府开启了全面推进依法治国的新征程,加快了建设法治政府的步伐。国家间的法律交流变得空前重要。而美国作为发达国家,其设立的相对完善、先进的法律体系无疑能够为中国建设法治政府提供一些参考。因此,外国法律文本的汉译工作就显得尤其迫切且重要。在报告中,作者在分析了原文本的本质特征后,选择文本类型理论作为指导,且在翻译过程中严格遵守了法律对等和语用对等的原则。为了实现语言功能和法律效果的对等,作者主要运用了语用充实的方法并使用了直译、创造性翻译、词类转换、增译、减译以及改译的翻译策略。在此翻译报告中,作者主要关注三个问题:如何翻译判决书中的案例编号;如何翻译法律词汇(包括:无普通词意义的普通词,专业术语,法律行话,正式程度较高的词汇);如何翻译法律长句(尤其是如何翻译无主被动句和强调句)。根据文本类型理论,在翻译法律术语和复杂句型时,作者采用了不同的翻译策略以期实现法律对等。同时,作者也概括出了相关技巧来解决上述的三个问题。
