中国庭审问答中欺骗性言语行为识别研究

　　庭审中,当原告或被告的利益受到威胁时,他们会做出虚假陈述,试图影响法官对案件的判断,以此逃避或减轻惩罚。本文将法庭中虚假陈述的行为定义为“欺骗性言语行为”。欺骗性言语行为会影响法官的判断,浪费司法资源,损害社会公平和诚信。因此,识别欺骗性言语行为具有重要的法律意义,它可以提高法庭审判的效率,增强法律体系的权威性。尽管识别欺骗是一个热门问题,也受到来自多个学科学者的关注,但很少有中国学者在具体的语境中研究这个问题。因此,本研究旨在中国庭审问答的语境下,找到能有效识别欺骗性言语行为的“欺骗性言语识别词”。本研究共收集10个真实的庭审案件,转写出28段语料,并对其中的19段进行详细分析。基于两大类识别欺骗的线索（语言控制,情感和认知运作）和10个已被证实有效的“欺骗性言语识别词”,本研究搭建识别欺骗性言语行为的分析框架。语言控制使欺骗者主动地采取策略（即隐匿、捏造和歪曲）来达到其目的,主要通过8个“欺骗性言语识别词”得以实现（模糊词、概括词、强调词、套话、指向他人、弱化词、条件句和连接词）。另外两个“识别词”（否定词和重复）实现了情感和认知运作中否定态度和认知活动的减缓。在此框架下,本研究对...
