《国际商事合同中的常客：诉讼而非仲裁》翻译实践报告

　　此次翻译实践,笔者选取了一篇法律学术文本来进行英译汉实践。原文基于对大量国际合同的研究,反驳了国际合同更常采用仲裁条款而非诉讼条款这一普遍观点,并引证了大量的证据来证明事实并非如此。该文可引起以出口为主的中国企业对国际商事合同中诉讼条款的重视,从而更好地应对潜在的国际贸易合同纠纷。在本报告中,笔者依次介绍了本次翻译实践的背景、原文本的类型和特点以及翻译的全过程。笔者试图根据静态对等策略和法律翻译原则,重点从词汇、句法和语篇三个层面来分析这一法律文本的翻译。通过此次翻译实践,笔者希望可以引入国外创新的法律观点来促进国际法律交流。同时,希望本报告所观察和总结的法律学术文本中典型词句的翻译方法,能够对国际商事合同研究论文的翻译,乃至法律学术文本的翻译有些许借鉴意义。
