高中生法治意识状况研究

【摘要】：随着十八届四中全会的召开,法治再度成为人们关注的话题,如何建设成为法治国家、培养公民的法治意识也成为需要解决的问题。高中生作为一个国家未来的希望,他们法治意识现状如何不仅仅关系到个人今后的发展,同时也对教育事业的发展,乃至今后整个国家法治社会能否顺利建成都产生着深远的影响。因此,高中生的法治意识状况如何、存在哪些不足是每个教育者,尤其是高中政治教师应该尤其关注的。法治意识作为一种意识,它来源于人们对于法治的态度和看法。而法治与以往我们所提的法制又有很大的区别,因此,必须加以区别。而对于法治的深刻理解,可以让我们更加清楚的认识法治意识的内涵。法治意识主要包括三个层次：权责意识、规则意识和宪法至上意识,而每一个层次又包含了若干方面。其中,权责意识又包括守法意识、维权意识和民主参与意识,规则意识包含法律至上意识、程序优先意识、自律意识,宪法至上意识包括人民主权意识、人民至上意识以及权力制衡意识。由于高中生的生活阅历和认知水平有限,因此,在高中阶段我们应该有重点的培养其法治意识。根据法治意识的内涵,以及结合当代高中生的特点,通过调查发现,当代高中的法治意识状况还有很多的不足和需要提高的地方,当然也有认知状况较好的方面。总体而言,高中生的规则意识状况较好,尤其是在自律意识方面,而公民意识和宪政意识相对薄弱,在很多方面还有认知不清或者是认知与行动脱节的现象,这需要学校、社会和家庭三个方面共同努力来帮助他们不断改善现状。根据学生现存的问题,要主要从学校层面进行改善,因为高中阶段的学生受到学校教育影响的程度更大,再辅之以家庭氛围和社会环境的熏染,为高中生创造一个良好的法治环境,必将对其法治意识的养成产生积极的作用。
[Abstract]:With the convening of the fourth Plenary session of the 18 CPC Central Committee, the rule of law has once again become a topic of concern, how to build a country ruled by law. Training citizens' awareness of the rule of law has also become a problem to be solved. High school students as a country's hope for the future, how their awareness of the rule of law is not only related to the future development of individuals. At the same time, it also has a profound impact on the development of education, and even on whether the whole country can be built smoothly. Therefore, what is the status of high school students' awareness of the rule of law, and what are the shortcomings of each educator? The consciousness of rule of law, as a kind of consciousness, comes from people's attitude and view on the rule of law, and the rule of law is very different from the legal system that we have mentioned in the past. The deep understanding of the rule of law can make us understand the connotation of the consciousness of the rule of law more clearly. The consciousness of the rule of law mainly includes three levels: the consciousness of power and responsibility, the consciousness of rule and the consciousness of the supremacy of constitution. Among them, the consciousness of power and responsibility includes the consciousness of abiding by the law, the consciousness of protecting rights and the consciousness of democratic participation, and the consciousness of rule includes the consciousness of law first, the consciousness of procedure priority, and the consciousness of self-discipline. Constitution supreme consciousness includes people's sovereignty consciousness, people's supreme consciousness and power balance consciousness. Because of the high school student's life experience and cognition level is limited, therefore. In the senior middle school we should focus on the cultivation of its awareness of the rule of law. According to the connotation of the awareness of the rule of law and combined with the characteristics of contemporary high school students through the investigation found. There are still a lot of deficiencies and needs to be improved in the current high school awareness of the rule of law, of course, there are also better cognitive aspects. Overall, high school students' awareness of the rules is better, especially in the sense of self-discipline. But the citizen consciousness and the constitutionalism consciousness are relatively weak, in many aspects also has the cognition unclear or is the cognition and the action disjointed phenomenon, this needs the school. Three aspects of society and family work together to help them improve their current situation. According to the existing problems of students, we should mainly improve from the school level. Because the students in the senior middle school are affected more by school education, and then supplemented by the influence of family atmosphere and social environment, to create a good environment of rule of law for senior high school students. It will certainly have a positive effect on the cultivation of its consciousness of ruling by law.
