从“管理法”走向“平衡法”:中国公立高校学生管理规则系统的演进逻辑

【摘要】：20世纪90年代以来,受国家逻辑(包括立法规制、司法审查与行政监督)、大学逻辑、学生个体逻辑以及民间社会逻辑等多重制度逻辑的深刻影响,中国公立高校学生管理规则系统呈现出从“管理法”向“平衡法”的演进轨迹。《普通高等学校学生管理规定》自1990年以来的两次修订以及各公立高校学生管理规则的演进表明,大学自治正在接受法治拷问。正当程序原则、比例原则、法律保留原则、信息公开原则等行政法治的基本原则开始逐渐被特殊“适用”,学术自治与权益保护的平衡成为规则演进的价值旨归。传统的受教育权范式正在被倡导学习自由的学习权所取代,将学习的权利还给学生成为趋势。作为特殊行政主体或特别公法人的公立高校,其法治秩序的建构日益重视回应高教法治与行政法治的演进趋势并嵌入与吸纳其有益要素。中国公立高校学生管理规则系统应更加重视法治思维与精神的凝练,彰显“平衡法”的基本理念与实践模式。“平衡法”的兴起亟待重构多重制度逻辑,寻求国家监督、大学自治与学生权益保护等多重冲突利益之间的平衡。通过“国家法”与“大学法”、“硬法”与“软法”的良性互动,促进大学哲学内涵的法律化。
[Abstract]:Since the 1990s, it has been deeply influenced by the multi-system logic, such as national logic (including legislative regulation, judicial review and administrative supervision), university logic, student individual logic and civil society logic. The system of student management rules in Chinese public colleges and universities shows the evolution from "management law" to "balance law". The "regulations on Student Management in ordinary institutions of higher Learning" has been revised twice since 1990 and the evolution of student management rules in various public colleges and universities. University autonomy is being grilled by the rule of law. The basic principles of administrative rule of law, such as the principle of due process, the principle of proportionality, the principle of legal reservation, the principle of information disclosure, etc., have been gradually applied to the special "application", and the balance between academic autonomy and protection of rights and interests has become the value purport of the evolution of the rules. The traditional paradigm of the right to education is being replaced by the right to learn freely, and it is a trend to return the right to study to students. As a special administrative subject or special public legal person, public universities pay more and more attention to respond to the evolution trend of higher education rule of law and administrative rule of law, and embed and absorb its beneficial elements. The system of students' management rules in Chinese public colleges and universities should pay more attention to the condensed thinking and spirit of rule by law, and show the basic idea and practice mode of "balance method". The rise of "balance law" needs to reconstruct the logic of multiple systems and seek a balance between the interests of multiple conflicts such as state supervision, university autonomy and the protection of students' rights and interests. Through the positive interaction between "the State Law" and "the University Law", "hard Law" and "soft Law", the legalization of the connotation of university philosophy is promoted.
