商品房预售中消费者权益的法律保护

【摘要】:近年来,商品房预售作为一种商品房销售的方式,得到了广泛的运用,并有效的促进了中国房地产市场的发展。商品房预售制度不仅提高了资金的使用效率降低了资金的使用成本,扩大了商品房的开发规模,而且对活跃房地产市场,促进居民住房条件的改善也有积极意义。本文笔者主要是针对商品房预售过程中消费者权益的保护情况进行研究,首先从我国商品房预售的概念特征及消费者权利义务状况入手,分析出商品房消费者权益受到侵害的可能出现的各种类型,并总结出消费者受到侵害的原因。然后就先进国家和地区的经验提出了相应的参考意见。最后为先善商品房预售制度,保护商品房消费者的权益,提出了相应的解决问题的办法和对策。
[Abstract]:In recent years, as a way of selling commercial housing, commercial housing pre-sale has been widely used. And effectively promoted the development of China's real estate market. The pre-sale system of commercial housing not only improves the efficiency of the use of funds, reduces the cost of the use of funds, expands the scale of development of commercial housing, but also enlivens the real estate market. It is also of positive significance to promote the improvement of housing conditions of residents. This paper mainly focuses on the protection of consumers' rights and interests in the process of pre-sale of commercial housing. First of all, starting from the conceptual characteristics of the pre-sale of commercial housing and the status of consumers' rights and obligations in China, this paper analyzes the various types of consumer rights and interests of commercial housing that may be infringed. And summarizes the reasons why consumers have been infringed upon. Then it puts forward the corresponding reference opinions on the experience of advanced countries and regions. Finally, it is to improve the pre-sale system of commercial housing and to protect the rights and interests of the consumers of commercial housing. The corresponding solutions and countermeasures are put forward.
