论我国房屋买卖居间合同

【摘要】:近年来我国城市化建设发展迅速,我国房地产市场空前活跃。同时,房地产市场的活跃催生了房屋中介服务的出现,房屋中介机构在各个城市街头也如雨后春笋般应运而生。现实生活中,房屋中介服务机构以其投入资金少、经营灵活、方便快捷的特点活跃在房屋买卖的市场上,在市场经济活动中发挥着重要的作用。但由于我国在房地产经纪服务法律领域的不健全,,尤其是房地产房屋居间合同出现的一系列纠纷,使得该领域制度不合理、合同不规范的困境愈益明显。因此,非常有必要对房屋居间合同问题的进行研究。 本篇文章首先从对房屋买卖居间合同的界定入手,分析了房屋居间合同的涵义、种类、性质、特征;其次阐述了房屋买卖居间合同国内外的立法现状;及问题分析。再次,就是运用实证的分析方法分析了我国房屋买卖居间合同实践中存在的诸多法律问题:如实务中出现的“跳单”行为、关于居间人“吃差价”、不如实告信息之行为等;最后笔者在借鉴其他学者的基础上,结合自己的实践,对进一步完善和规范房屋买卖居间合同提出了自己的建议,希望通过自己对相关问题的讨论和理解能为我国相关法律的完善,尽一点绵薄之力。
[Abstract]:In recent years, the development of city construction in China rapidly, China's real estate market is very active. At the same time, the active real estate market gave birth to the emergence of housing intermediary services, housing intermediaries in various city streets like bamboo shoots after a spring rain came into being. In real life, the housing intermediary service institutions with less investment, flexible operation, characteristics convenient and active in the sale of housing market, plays an important role in the activities of market economy. But because China's real estate brokerage services in the field of law is not perfect, especially a series of real estate intermediary housing contract disputes arise, the system is not reasonable, the plight of the contract was not standardized increasingly obvious therefore, it is necessary to study the housing intermediary contract problem.
This article starts from the definition of the sale of housing intermediary contract with the analysis of the housing intermediary contract meaning, types, properties, characteristics; secondly describes the legislative status of the housing sales intermediary contracts at home and abroad; and problem analysis. Thirdly, is to use the analysis method of the empirical analysis of many legal problems of China's housing sales the intermediary contract in practice: such as practice in the emergence of the "jump" behavior, a intermediary to eat the difference, not the behavior of information; finally the author on the basis of other scholars, combined with their own practice, to put forward their own proposals to further improve and standardize the intermediary housing sale contract. Hope that through the discussion and understanding of issues related to the improvement of China's relevant laws, as a little bit.
