房地产限购令的法律问题研究

【摘要】:旨在调控房价非理性增长的限购令,具有实质法治意义上的正当性。民法学界的指诘,援引古典契约自由理论,认为限购令以户籍限制干预合同自由,并危害法治秩序。但仅基于形式正义理念进行体系化的逻辑推理,难以维护法和社会秩序的安定价值,游离于法教义学思维之外;在法学研究方法转型、法教义学获得重新解读以及社科法学已显端倪的格局中,未能摆脱路径和方法依赖的民法学界将面临极大的挑战。
[Abstract]:The order of controlling the irrational increase of house price has the legitimacy in the sense of rule of law. Referring to the classical theory of freedom of contract, the civil law circle holds that the purchase restriction order interferes with the freedom of contract with the household registration restriction and endangers the order of ruling by law. However, it is difficult to maintain the stable value of law and social order only based on the concept of formal justice, and it is difficult to maintain the stable value of law and social order. In the pattern of legal dogmatics being reinterpreted and social science law appearing, the civil law circle which can not get rid of the path and method depends on it will face great challenge.
