法治中国背景下互联网管理机制的整体设计——消解互联网公共舆论的“内向坍塌”危机

【摘要】：[目的/意义]当前我国互联网公共舆论正面临着内向坍塌危机,通过管理机制调整促进互联网公共舆论繁荣,不仅关系到网民权利保障而且有利于国家与社会间良性互动。[方法/过程]在典型案例和大量数据的基础上,通过实证分析,总结互联网公共舆论内向坍塌危机的现实表现。探究现行互联网公共舆论管控模式和治理模式的特点及其造成内向坍塌危机的因果过程,结合法治中国建设背景,通过规范研究提出管理机制改进建议。[结果/结论]消解内向坍塌危机,构建互联网公共舆论管理法治机制体系应当遵循五项总体要求并建设六大具体机制:信息沟通机制、协商决策机制、协作互助机制、监督制衡机制、权利保障机制和裁决救济机制。
[Abstract]:[purpose / significance] at present, the Internet public opinion in our country is facing the crisis of introverted collapse. Promoting the prosperity of Internet public opinion through the adjustment of management mechanism is not only related to the protection of the rights of netizens, but also conducive to the benign interaction between the state and society. [methods / process] on the basis of typical cases and a large number of data, through empirical analysis, this paper summarizes the realistic performance of the inward collapse crisis of Internet public opinion. This paper probes into the characteristics of the current Internet public opinion control mode and governance mode and the causality process of the inward collapse crisis, and puts forward some suggestions for improving the management mechanism through the normative research combined with the background of the construction of China ruled by law. [results / conclusion] to resolve the inward collapse crisis, to construct the rule of law mechanism system of Internet public opinion management should follow five general requirements and build six specific mechanisms: information communication mechanism, consultation and decision-making mechanism, cooperation and mutual assistance mechanism. Supervision and balance mechanism, right protection mechanism and adjudication relief mechanism.
