英国《1988年版权、外观设计和专利法案》英汉翻译实践报告

随着国家知识产权战略的深入实施以及对外开放水平的不断提高,我国越来越重视对外知识产权交流,特别是知识产权立法交流。由于英美国家在知识产权立法方面积聚了丰富经验,知识产权立法文本翻译研究可以为我国立法机关、行政部门、企业及法学研究人员提供基础性参考资料,从而促进我国知识产权法律制度的完善,服务于创新型国家建设目标。本报告基于英国《1988年版权、外观设计和专利法案》英汉翻译实践,以纽马克的语义翻译和交际翻译为理论指导,尝试解决知识产权立法文本英译汉中的典型问题。作为法律文本的一种类型,知识产权立法文本包含大量法律术语、知识产权术语及模糊语,句型多为长难句及被动句,语篇结构严谨、风格庄重、逻辑严密。这些语言特征给翻译工作带来极大挑战,使译者常面临如下影响文本信息准确传递的问题:词汇层面,法律术语、知识产权术语以及模糊语翻译准确性欠佳;句法层面,长难句及被动句误译;篇章层面,语篇衔接不当,译文语言风格不统一。纽马克的语义翻译和交际翻译理论强调通过语义翻译保留原文的语境意义,以交际翻译来优化文本信息内容的传达、增强译文可读性。在纽马克语义翻译和交际翻译理论的指导下,通过实施以下对策,可以有效解...
