试论法律词汇空缺及其翻译策略

【摘要】：中国日趋频繁地参与全球舞台上的国际事务离不开法律翻译所发挥的重要作用。被视为"最终的语言挑战",法律翻译作为跨学科科目,其是不同民族和不同文化之间在法律和其他领域相互交流合作的重要组成部分。由于源语言和目标语言之间的差异,词汇空缺时常成为法律文本翻译中的棘手问题。词汇空缺,又可称为词汇缺项,在跨文化交流特别是翻译活动中十分常见。对于这一问题,翻译理论界提出了许多理论加以阐释。在法律文本翻译中,也存在着这一问题,可称为法律词汇空缺。可是,由于法律文本深植于它们所属的文化,并包含大量具有特定文化内涵的法律词汇,法律文本翻译者常常在应对法律词汇空缺的翻译时感到无从下手。本文旨在从对等理论的角度阐述法律词汇空缺,主要应用了文献分析法、例证法和对比分析法来说明尤金·奈达的功能对等理论和苏珊·萨尔切维奇的对等理论在指导法律翻译中的应用。本文还详细探讨分析法律词汇空缺的原因,包括根本原因和文化原因。其中,根本原因源自法律英语的特征。文化原因是不同法律文化在法律语言中的体现。另外,基于苏珊·萨尔切维奇对对等的分类基础之上,本文还尝试列举了几种翻译中常用的应对法律词汇空缺的方法,如不译法、直译法、新词法、构词法和释义法等。对于法律词汇空缺的研究有助于我们更好理解法律语言本身,提高法律翻译水平。
[Abstract]:China's increasingly frequent participation in international affairs on the global stage cannot be separated from the important role played by legal translation. Regarded as "the ultimate language challenge", legal translation, as an interdisciplinary subject, is an important part of the exchange and cooperation between different nationalities and cultures in law and other fields. Because of the difference between source language and target language, lexical vacancy often becomes a difficult problem in legal text translation. Vocabulary vacancy, also called lexical vacancy, is very common in cross-cultural communication, especially in translation activities. Many theories have been put forward to explain this problem. This problem also exists in the translation of legal texts, which can be called a vacancy of legal vocabulary. However, due to the fact that legal texts are deeply rooted in their culture and contain a large number of legal words with specific cultural connotations, legal translators often find it difficult to deal with the translation of legal vocabulary gaps. The purpose of this paper is to expound the vacancy of legal vocabulary from the perspective of equivalence theory. Examples and comparative analysis illustrate the application of Eugene Nida's functional equivalence theory and Susan Salchevich's equivalence theory in guiding legal translation. This paper also analyzes the reasons of the legal vocabulary vacancy, including the root causes and cultural reasons. Among them, the root cause originates from the characteristics of legal English. Cultural reason is the embodiment of different legal culture in legal language. In addition, based on Susan Sarcevic's classification of equivalence, this paper also tries to enumerate several common ways of dealing with legal vocabulary vacancy in translation, such as non-translation, literal translation, neologism, word-formation and interpretation, and so on. The study of legal vocabulary vacancy can help us better understand the legal language and improve the level of legal translation.
