法庭口译员对庭审的语言重建功能探究

【摘要】：正一、研究背景随着全球化进程不断加深,我国每年涉外案件的数量呈现急剧增长的趋势,而法庭审理既是人民法院行使国家审判权的重要阶段,又是当事人行使诉权实现其法律主张、维护其法律权益的重要环节。涉外案件由于涉及到多国语言,对于使用案件管辖地(国)以外语言的一方当事人来说,语言劣势将妨碍其法律权益的保障。因此,法庭口译成为了维护平等法律权益
[Abstract]:First, with the deepening of the globalization process, the number of cases involving foreign affairs in China is increasing rapidly every year, and the court hearing is an important stage for the people's court to exercise the state jurisdiction. It is also an important link for the parties to exercise their right of action to realize their legal claims and safeguard their legal rights and interests. Because foreign cases involve many languages, for a party who uses a language other than the jurisdiction of the case, the language disadvantage will hinder the protection of their legal rights and interests. As a result, court interpretation has become a defence of equal legal rights and interests
